A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ROSEMEAD GRANTING A
CONDITIONAL USE PERMIT IN CONDITIONAL
USE PERMIT CASE NO. 88.
THE PLANNING COMMISSION OF THE CITY OF
ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby
find and determine that an application was duly filed by
Mr. Robert Tom, with respect to real property described as:
3018 San Gabriel Boulevard, Rosemead;
requesting the sale of on-site beer at the above address which
is within 200 feet of residentially zoned property;
that a public hearing was duly set for July 6, 1976, at
7:30 p.m. in the Council Chambers of the Rosmmead City Hall,
8838 Valley Boulevard, Rosemead, California and a.notice of
the time, date, place and purpose of aforesaid hearing was
duly given; that a hearing was duly held at the aforementioned
time•'and place.
Section 2. The Planning Commission further finds
and determine acts do exist as required by Section 9180 et
seq. of the Ordinances of the City of Rosemead justifying
a granting of the Conditional Use Permit.
Section 3. The Planning Commission further finds:
1. Compliance with the Conditions of Approval will
insure that the project will not be detrimental
to the surrounding properties.
2. The project is desirable to the public convenience.
3. The proposed use is in conformance with the
General Plan.
4. As the internal operation will not create
objectionable noise or odors the proposed
project should be compatible with surrounding
development.
5. The application has been determined to be
categorically exempt within the definition
of Section 15101 of the Guidelines for the
Implementation of CEQA.
.S'ection 4. Based on the aforementioned findings the
Commission hereby grants a Conditional Use Permit with respect
to the property described in Section 1 of this Resolution
subject to the following conditions:
1. Subject property shall be operated and-maintained
solely as a bonafide restaurant serving food'to
the public.
2. Parking area adjacent to the restaurant to be
kept clean of debris and trash.

3. This permit shall expire 3 years from the date of
this approval except.that the owner may apply
for an extension of time and the Commission may
consider and grant such extension of time as
they then consider appropriate.
4. This Conditional Use Permit shall not become
effective until the owner/applicant of the
property involved has filed with the Planning
Department a signed affidavit of acceptance of
conditions.
Section 5. This action "shall become final and
effective ten 10 days after this decision by the Planning
Commission unless within such time a written appeal is filed
with the City Clerk, for consideration by the Rosemead
City Council as provided in the Zoning Ordinance.
Section 6. The Secretary shall certify to the
adoption of the Resolution and shall transmit copies of the
same to the applicant and the Rosemead City Clerk.
