PC - 1976-05 - Granting a conditional use permit in conditional use permit case no . 76-2CITY OF ROSEMEAD PC RESOLUTION 76r-:5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 76-2. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Mr. David Pimentel,.with respect to real property described as 9351 E. Mission Drive, Rosemead, California; requesting the sale of on-site beer and wine at the above address which is within 200 feet of residentially zoned property. That a public hearing was duly set for March 15, 1976 at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California and a notice of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determine acts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. Compliance with the Conditions of Approval will insure that the project will not be detrimental to the surrounding properties. 2. The project is desirable to the public convenience. 3. The Rosemead General Plan proposes Service/Regional Commercial for this area and this proposed use is in conformance with the General Plan. 4. As the internal operation will not create objectionable noise or odors and conditions require installation of adequate parking, the project should be compatible with surrounding development and desirable for the public convenience. 5. The application has been determined to be categorically exempt within the definition of Section 15101 of the Guidelines for the Implementation of CEQA. Section 4. Based on.the aforementioned findings the Commission hereby grants a Conditional use permit with respect to the property described in Section l'of this Resolution subject to the following conditions: 1. Approval of electrical work be secured. 2. Approval for restfoom facilities by the Industrial Wast and Health Department be secured. 3. Supply trash containers and maintain the property, parking area, and sidewalks in a clean and litter free state. 4. The subject property shall be operated as a restaurant and food must be available on the premises. 5. There shall be no use of flashing or blinking lights or signs. 16. The occupancy capacity of the restaurant shall not exceed 30 persons at any time. 7. This permit shall expire two years from the date of this approval, except that the owner may apply for an extension of time, and the Commission may consider and grant such extension of time as they then consider appropriate. 8. This Conditional Use Permit shall not becomes effective until the owner/applicant of the property involved has filed with the Planning Department a signed Affidavit of Acceptance of Conditions. 9. This permit shall not become effective :;ntil all the conditions of the Building Department are satisfied concerning restroom standards and electrical standards. 10. Eight parking spaces shall be s-:riped Section 5. This action shall become final and effective ten 10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of the Resolution and shall transmit copies of the same to the applicant and the Rosemead City Clerk. ADOPTED this 15th day of March, 1976.
