A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY
OF ROSEMEAD ADOPTION OF AMENDED SECTIONS 9119 AND 9119.4
OF THE ROSEMEAD MUNICIPAL CODE REGARDING THE DESIGN AND
DEVELOPMENT PLAN IN THE D-DESIGN ZONE.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY
RESOLVE AS FOLLOWS:

The Planning Commission does hereby find and

amendment to the D Overlay Zone is in the public interest and the
general welfare will be served and good zoning practices will be
followed in approval of this amendment.
Section 3. The Planning Commission finds that a Negative
Declaration was prepared in compliance with the California Environmental
Quality Act (CEQA), the Guidelines for the implementation of CEQA,
and Rosemead Resolution 75-28,
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROSEMEAD RESOLVES THAT,
Section 4. The Planning Commission of the City of Rosemead
does recommend to the City Council that Rosemead Municipal Code
Sections 9119 and 9119.4 be adopted to read as set forth on attachment
"A" hereto.

PART XIX - D ZONE (OVERLAY)
9119. D-DESIGN. Land classified in a D Zone shall also be classified
in another zone. The following regulations shall apply in the
D-Design Zone unless otherwise provided in this Chapter.
9119.1 PURPOSE. In order to assure an orderly development and that
buildings, structures, signs and landscaping will be harmonious
within a specified area; to prevent the development of structures
or uses which are not of acceptable.exterior design or appearance
or are of inferior quality or likely to have a depreciating or
negative effect on the local environment or surrounding area by
reason of use, design, appearance or other criteria affecting
value.
9119.2 JURISDICTION. No building permit shall be issued for any
building structure or other development of property or
appurtenance thereto, on any property for which a precise plan
of design is required, until the precise plan of design
covering the parcel or parcels to be so used shall be approved
and adopted as herein provided.
1. Commercial Uses--Design review procedures shall be followed
for all improvements requiring a building permit or visible
changes in form, texture, color, exterior facade or
landscaping.
2. Residential and Institutional Uses--Design review shall not
'be imposed on residential or institutional uses except
for improvements requiring a building permit for structural
alteration of a building. Painting, landscaping and normal
maintenance are expressly exempted from such review. For
all improvements requiring a building permit, the juris-
diction shall be as set forth in the preceding subsection.
9119.3 APPLICATION. Prior to the issuance of a building permit for the
erection, alteration, addition to or enlargement of, or the
moving or relocation of, any building or structure, in the D
Zone, an application shall be submitted with six sets of plans
to the Planning Department. Such application shall be on a form
prescribed by the Planning Commission. A fee of $50.00 for
commercial construction, and $25.00 for residential con-
struction shall be paid upon the filing of such application.
1. Contents.
Such precise plan of design shall specify and include but not
limited to the following information and appropriate site plans
and accompanying text:

9119.4 ACTION ON APPLICATIONS AND REVIEW CRITERIA
The Planning Commission or the Director where authorized,
may approve, approve with conditions, or disapprove any
application based on the following criteria:
1. The plans indicate proper consideration for the
relationship between the proposed building and site de-
velopments that exist or have been approved for the
general neighborhood;
2. The plan for the proposed building and site development
indicates the manner in which the proposed development and
surrounding properties are protected against noise,
vibrations and other factors which may have an.adverse
effect on the environment, and the manner of screening
mechanical equipment, trash, storage and loading areas;
3. The proposed building or site development is not, in
its exterior design and appearance, so at variance with
the appearance of other existino buildinqs or site develop-
ments,in the neighborhood as to cause the nature.of the
local environment to materially depreciate in appearance
and value;
4. The proposed building or structure is in harmony with
the proposed developments on land in the general area,
especially in those instances where buildings are within
or adjacent to land shown on the:Geinefal Plan as being
part of the Civic Center or in public or educational use,
or are within or immediately adjacent to land included
within any precise plan which indicates building shape,
size or style;
5. The proposed development is in conformity with the
standards of this code and other applicable ordinances
in so far as the location and appearance of the buildings
and structures are involved; and
6. The site plan-and the design of the buildings, parking
areas, signs, landscaping, luminaires, and other site
features indicates that proper consideration has been given
to both the functional aspects of the site development,
such as automobile and pedestrian circulation, and the
visual effect of the development from the view of public
streets.
