A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ROSEMEAD GRANTING A
CONDITIONAL USE PERMIT IN CONDITIONAL
USE PERMIT CASE 77-122.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby
find and determine that an application was duly filed by Mr.
John Hutton, with respect to real property described as:
3122 San Gabriel Boulevard, Rosemead, CA,
requesting the sale of on-site alcoholic beverages at the
above address which is within 200 feet of residentially zoned
property,
that a public hearing was-duly set for December 5, 1977 at
7:30 p.m. in the Council Chambers of the Rosemead City Hall,
8838 Valley Boulevard, Rosemead California and a notice of
the time, date, place and purpose of aforesaid hearing was
duly given; that a hearing was duly held at the aforemen-
tioned time and place.
Section 2. The Planning Commission further finds
and determines facts do exist as required by Section 9180
et seq.-of the Ordinances of the City of Rosemead justifying
a granting of the Conditional Use Permit.
Section 3. The Planning Commission further finds:
1. Compliance with the conditions of approval will
insure that the project will not be detrimental
to the surrounding.properties.
2. The project is desirable'to the public convenience.
3. The Rosemead General Plan proposes Service/Regional
Commercial for this area and this,proposed use is
in conformance with the 'General Plan.
4. As the internal,operation will not create objection-
able noise or odors, the project should be
compatible with surrounding development and
desirable for the public convenience.
Section 4. Based on the aforementioned findings
the Commission hereby grants a Conditional Use Permit with
respect to the property described in Section 1 of this
Resolution subject to the following conditions:
1. New owner to apply for appropriate City licenses
and occupancy permit.
2. Doors to remain closed during business hours.
3. Provide trash containers and maintain property
in a clean, litter free state.
4. Conditional Use Permit 77-122 is granted for a
period of two (2) years at which time it may.be
oeviewed for renewal by the Planning Commission
without'public hearing.
5. Applicant to sign affidavit of agreement
within ten days of approval.
6. This permit is issued to Mr. Hutton, personally
and not transferable:
Section 5. This action shall become final and
effective ten (10) days after this decision by the Planning
Commission unless within such'time written appeal is filed
with the City Clerk, for consideration by the Rosemead City
Council as provided,in the Zoning Ordinance.
Section 6.' The Secretary shall certify to the
adoption of.the Resolution and shall transmit copies of the
same to the applicant and the Rosemead City Clerk.
