A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD DENYING A ZONE VARIANCE
IN ZONE VARIANCE CASE NO. 77=84.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find
and determine that an application was duly filed by Thomas J.
Aleto, with respect to real property described as follows:
4915 - 4921 Walnut Giove'Avenue,.Rosemead, CA
requesting a Zone'Variance, on property in the M-1 Zone to permit;
construction of a warehouse within the 5''required
setback (sideyard) when property is adjacent to
R-zoned property,
that a public hearing was duly set for December 5, 1977, at 7:30
p.m, at the Rosemead City Hall, 8838 Valley Boulevard, Rosemead,
California; and a notice of the time, date, place, and purpose
of the aforesaid hearing was duly given; that a hearing was duly
held at the aforementioned time and place.
Section 2. The Planning Commission further finds and
determines that facts do not exist as required by Sections 9170
and 9186 et seq: of the Ordinances' of the City of Rosemead which
would justify the granting of the Zone Variance.
Section 3. The Planning Commission further finds:
Other industrial developments in Rosemead, adjacent
to residential lots have been required to meet the
setback to protect the residential homes from any
detrimental effects of industrial development . . .
This Variance will permit the warehouse to be
built so near the property line as to prevent the
adjacent homeowners from having access to one
side of their structures. It will also be an
obstruction to light and may cause a problem in
fire fighting.'. .
Staff can find no exceptionable circumstances
applicable to.this property that do not apply
to other properties in the M-1 Zone. . .
In the zoning of property for certain uses, one
objective of the General Plan is to protect the
integrity of each zone, so as not to be detrimental
or encroach upon the lawful uses proposed in an
adjacent zone.' The placement of a warehouse within
one foot of residential structures is definitely
not in keeping with this objective.
Sec'ti'on 4.' Based on the aforementioned findings the
Commission hereby denys a Zone Variance with respect to that
property described in Section 1 of this resolution.
Section 5. This action shall become final and
effective ten (10) days after this decision by the Planning
Commission unless within such time a written appeal is filed
with the City Clerk, for consideration by the Rosemead City
Council as provided"in the Zoning Ordinance.
Section 6. The Secretary shall certify to the adoption
of this resolution and shall transmit copies of same to the
applicant and the Rosemead City Clerk.
