PC - 1977- 31 - Granting Use Permit In Conditional Use Permit Case No. 77-117PC RESOLUTION 77 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 77-117. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Frederick B. Danziger, M.D. , with respect to real property described as: 4509 Rosemead Boulevard, Rosemead, California; requesting the operation of a Learning Center for approximately.twelve educationally handicapped children at the above address, which is in the C-3 Commercial Zone; that a public hearing was duly conducted on September 6, 1977, at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was given according to Law. - Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et seq., of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. Compliance with the Conditions of Approval will insure that the project will not be detrimental to the surrounding properties. 2. The project is desirable to the public convenience. 3. The proposed use is in conformance with the General Plan. 4. As the internal operation will not create objectionable nAse or odors, the proposed project should be compatible with surrounding development. 5. A Negative Declaration was prepared in compliance with the California Environmental Quality Act, the Guidelines for the Implementation of CEQA, and Rosemead Resolution 75-28. Section 4. Based on the aforementioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. All- conditions imposed;by.the- Los Angeles:-County Fire Department and Building and Safety Department, be met. 2. The proposed use be maintained and operated as described by the applicant. 3. The applicant obtain all necessary permits from appropriate Government Agencies regarding school facilities. 4. All loading and unloading of the children for this school to be at 4519 Rosemead Boulevard. 5. The applicant sign an affidavit agreeing to the preceeding conditions"-within 10 days. 6. Use not be otherwise prohibited by law as a result of its proximity to a business selling alcoholic beverages. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the zoning ordinance. Section 6. The Secretary shall certify to the adoption of the Resolution and shall transmit copies of the same to the Applicant and the Rosemead City Clerk.
