PC - 1978-28 - Denying a conditional use permit in case no. 78-136PC RESOLUTION 78-28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A CONDITIONAL USE PERMIT IN CASE NO. 78-136. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Jesus Lopez and Francisco Gonzales, for a Conditional Use Permit pursuant to Rosemead Municipal Code Section 9180 et seq for property located at: 9133 East Valley Boulevard, Rosemead, California for the sale of beer and wine in conjunction with an existing bar known as, "E1 Gallo de Oro". Section 2. A Public Hearing was duly conducted on November 6 and.l-at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the afore- said hearing was given according to law. Section 3. The Planning Commission further finds an$..de-._ termines t at ' acts .ado not exist as; required; by` Section' 9180 ands" 9181 of the Rosemead Municipal Code to justify a granting of this Conditional Use Permit. Section 4. The Planning Commission further finds that: (1) The project is not deemed essential or desirable to the public convenience because of nuisance complaints, i.e., neighborhood disturbances and noise generating from the bar. (2) The proposed project will be detrimental to surrounding property values and to the general welfare of nearby residents. (3) A Negative Declaration was prepared in compliance with the California Environmental Quality Act, the Guidelines for the implementation of CEQA, and Rosemead Resolution 75-28. Section 5. Based on the aforementioned findings, the Com- missionn e-reTy-denies a Conditional Use Permit with respect to the property described in Section 1 of this Resolution. Section 6. This action shall become final and effective ten (1 ays after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. The Secretary shall certify to the adoption of the Reso utionand shall transmit copies of the same to the applicant and the Rosemead City Clerk.
