PC - 1978-12 - Rosemead Granting Conditional Use Permit 78-128PC RESOLUTION 78-12 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 78-128 THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find an etermine that an application was duly filed by Ariel Ferrales with respect to real property described as: 7900 Garvey Avenue, Rosemead; requesting the continuation of on-site sale of alcoholic beverages at the above address. That a public hearing was duly set for June 19, 1978 at 7:30 p.m. at the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California and a notice of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforesaid mentioned time and place. Section 2. The Planning Commission further finds and d-mieternes facts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. Compliance with the Conditions of Approval will insure that the project will not be detrimental to the surrounding properties. 2. The project is desirable to the public convenience. 3. The Rosemead General Plan proposes Service/ Industrial with Regional/Commercial Centers for this area, and this proposed use is in conformance-with the General Plan. 4. As the internal operation will not create objectionable noise or odors, and the applicant's intent to furnish additional parking, the project should be compatible with surrounding development and desirable for the public convenience. Section 4. Based on the aforementioned findings the Commission hereby grants a Conditional Use Permit with respect to the property described in Section l.of this Resolution, subject tor;the following conditions: 1. Apply for City of Rosemead Business License for public eating. 2. Apply for City of Rosemead Occupancy Permit. 3. Apply for Demolition Permit for removal of the barber shop. 4. Doors to remain closed at all times during business hours. 5. No signs or advertisements are to be painted or adhesive inscribed on the structure itself. 6. Comply with Section 5401-5415 of the Rosemead Municipal Code which deals with the storage, accumulation, collection and disposal of garbage, trash, rubbish and debris. Property, parking area and sidewalks to be main- tained in a clean, litter free state. The City will not release their protest from the Alcoholic Beverage Control until such time that all the above conditions have been met. 9. An affidavit of agreement to be filed with the Planning Department within ten (10) days after approval by the Planning Commission. 10. This Conditional Use Permit shall be granted for a period of one year, at which time it may be reviewed for renewal by the Planning Commission without benefit of a Public Hearing. This Con- ditional Use Permit is not transferable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 11. Parking area to be resurfaced in accordance with the City Code. 12. Bachelor apartment to be inspected and either (a) rehabilitated or (b), demolished. 13. House at rear to be rehabilitated in conformity with City Code for rehabilitation structures. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead 5j_t_yClerk.
