PC - 1978-09 - Denying a Conditional Use Permit in Conditinal Use Permit Case No. 78-125PC RESOLTUION 78-9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 78-125. THE PLANNING;COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine tfat an application was duly filed by Pastora T•. Johnston et al, for a Conditional Use Permit pursuant to Rosemead Municipal Code Section 9180 et seq.for property located at: 8846-8852 Mission Avenue, Rosemead, California for the establishment and operation of a School for Developmentally Disabled adults, pursuant to Rosemead Municipal Code Section 9181 (7). Section 2. A Public Hearing was duly conducted on May 1, and June 3-,-T978, at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was given according to law. Section 3. The Planning Commission further finds and . determines t at facts do not exist as required by Section 9180 and 9181 of the Rosemead Municipal Code to justify a granting of this Conditional Use Permit. Section 4. The Planning Commission further finds that (1) The project is not desirable or a convenience to the public because similar facilities are available elsewhere,within a reasonable distance from Rosemead. (2) The proposed ;_use...in_not-,in.conformance with-the---General Plan because.the school may result in disruption of .the goals and policies for residential and com- mercial development. (3) The proposed project would not be compatible with surrounding development; f (4) The proposed project will be detrimental to surro- uhd"ing property values and to-the general welfare of nearby residents. (5) A Negative Declaration was prepared in compliance with the California Environmental Quality Act, the Guidelines for the implementation of CEQA, and Rosemead Resolution 75-28. Section 5. Based on the aforementioned findings, the Commission e eFy denies a Conditional Use Permit with respect to the property described in Section 1 of this Resolution. Section 6. This action shall become final and effective ten (10 ays a ter this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. i Section 7.
