PC - 1978-06 - Granting a conditional use permit in conditional use permit case 78-124CITY OF ROSEMEAD PC RESOLUTION 78-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE 78-124 THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by David J. Ruggles and Kay Jones with respect to real property described as: 9632 Valley Boulevard, Rosemead; requesting the continuation of on-site sale of alcoholic beverages at the above address. That a public hearing was duly set for April 17, 1978 at 7:30 p.m. at the Rosemead-City Hall, 8838 Valley Boulevard, Rosemead, California and a notice of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines facts do exist as required by Section 9180 et seq. of the ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The one main structure on the property has adequate setbacks from the adjoining residential properties. 2. The internal operation does not create objectionable noises or odors. 3. -Adequate off-street parking is provided. 4. Adequate ingress and egress plus satisfactory internal traffic circulation is provided. 5. The project is in harmony with the elements of objectives of the Rosemead General Plan. 6. The project will not be detrimental to surrounding property. 7. The project is desirable for public convenience. Section 4. Based on the aforementioned findings the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of_ this Resolution, subject to the following conditions: 1. The applicant to comply with the requirements of the Building Department and Health Department. 2. Applicant to comply with the requirements of the Fire Department. -2- 3. Secure all appropriate licenses from the City of Rosemead. 4. The door to remain closed at all times during the hours of operation. 5. The Conditional Use Permit is approved for a two-year period, at which time it may be reviewed for renewal by the Planning Commission without a public hearing. This permit is not transferrable to future purchasers or occupants. The applicant agrees it is the party responsible for'all conduct on the premises. 6. Provide trash containers and maintain the property in a clean, litter free state. 7. Comply with Sections 5401-5415 of the Rosemead Municipal Code which deals with the storage, collection, accumulation and disposal of garbage, rubbish, trash and debris. 8. Within ten (10) days after approval by the Planning Commission, an affidavit of agreement be signed, notarized and filed with the Planning Department. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead City Clerk.
