PC - 1978-24 - Granting Conditional Use Permit 78-134PC RESOLUTION 78-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 78-134. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and--ermine that an application was duly filed by the Committee of Baha'_i Faith with respect to real property described as: 4022 Rosemead Boulevard, Rosemead, California requesting the above mentioned site to be used for religious meetings in the CBD zone. That a public hearing was duly set for September 5, 1978, at 7:30 p.m. in the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California and a notice of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the afore- said mentioned time and place. Section 2. The Planning Commission further finds and et~ermines facts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. Compliance with the Conditions of Approval will insure that the project will not be detrimental to the surrounding properties. 2. The project is desirable to the public convenience. 3. As the internal operation will not create objec- tionable noise or odors, the project should be compatible with surrounding development and de- sirable for the public convenience. Section 4. Based on the aforementioned findings the Commissireby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. The applicant shall apply for an Occupancy Permit and comply with all requirements of Building and Safety, Fire and Health Departments. 2. The proposed use, i.e., religious meetings, dis- cussions and classes, shall at all times be conducted within the enclosed building. 3. The occupancy capacity shall not exceed 50 persons at anytime. 4. All signs shall comply with provisions of the C-3 Ordinance, and upon expiration.of this permit, any signs shall be removed from the subject property. 5. All items related to the proposed use shall be displayed entirely within the enclosed building. 6.. The entire property is to be kept in a clean and orderly fashion at all times. 1 7. This Conditional Use Permit is approved for nine months, at which time it may be reviewed for renewal by the Planning Commission without a Public Hearing. This permit is not transferable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 8. The applicant shall document availability of and maintain parking meeting or exceeding the requirements of Sections 9122.7 and 9122.12 of the Rosemead Municipal Code. 9. Within ten (10) days after approval, the applicant shall submit a notarized affadavit of agreement to these conditions with the Planning Department. Findings: 1. The project is in harmony with the elements and objectives of the City's General Plan. 2. The project will not be detrimental to the sur- rounding properties. 3. The project is desirable for the public convenience. Section 5. This action shall become final and effective ten TEUT-Ta-ys after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of tii i sution and shall transmit copies of the same to the applicant and the Rosemead City Clerk.
