PC - 1979-45 - Granting Conditional Use Permit 79-167. 0 PC RESOLUTION 79-45 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT NO. 79-167. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was filed by Ting Huai and Yanan Shan to request the sale of alcoholic beverages for off-site consumption in conjunction with an existing market known as "M & M Market" and located at: 3358 Del. Mar Avenue, Rosemead, California; and that a public hearing was duly set for November 5, 1979, at 7:30 p.m., in the Council Chamber of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, place, date and purpose of the aforesaid hearing was duly given; and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et. seq. of the Ordinances of the City of Rosemead justifying the granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aformentioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Remove the graffiti along the south wall. 2. The trash area on the rear of the property shall be cleaned up and maintained in a clean, litter-free state. 3. Comply with Section 5401-5415 of the Rosemead Municipal Code which deals with the storage, collection and disposal of garbage, trash and debris. 4. Apply for all City Business Licenses and Occupancy Permits and comply with all requirements setforth by said permits. 5. This Conditional Use Permit is approved.for.a two-year period, at which time it may be reviewed by the Planning Commission without a public hearing. This permit is not transferable to future purchasers or occupants. The applicants assume responsibility for all conduct on the premises. 6. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement to the above conditions with the Planning Department and shall, within a reasonable period of time, satisfy these conditions with the knowledge that failure to do so may result in the revocation of this permit. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. • ADOPTED this 19th day of November 1979.
