A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING CONDITIONAL USE PERMIT NO. 79-165.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission does hereby find and determine that
an application was filed by Shyh Nian Sheen, Chyong Sheen and Carman Sheng to
request the sale of alcoholic beverages for off-site consumption in conjunction with
an existing liquor store known as "Mr. T's Liquor", located at:
8720 Garvey Avenue, Rosemead, California;
,and that a public hearing was duly set for November 5, 1979, at 7:30 p.m. in the
Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California,
and that notice of the time, date, place, and purpose of the aforesaid hearing was
duly given; and that a hearing was duly held at the aforementioned time and place.
Section 2. The Planning Commissionfurther finds and determines that
facts do exist as required by Section 9180 et. seq. of the Ordinances of the City
of Rosemead justifying granting of the Conditional Use Permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives of the
General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable for the public convenience.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a Conditional Use Permit with respect to the property described in Section 1
of this Resolution, subject to the following conditions:
1. Applicant to apply for a City of Rosemead Business License and Occupancy
Permit. All herein must be completed prior to issuance of said permits.
2. Comply with the requirements of the Building, Fire and Health Departments.
3. The rear portion of the subject property (to the utility pole anchor
line) shall be sully hard-surfaced in accordance with the latest standards
as set forth in the City of Rosemead, within six months from the date
of approval; May 5, 1980.
4. All parking spaces shall conform to the City standards as provided in
Section 9122 of the Rosemead Zoning Code and all parking spaces abutting
a property line or structure shall be provided with wheel stops.
5. Paving and striping of the parking area and driveway shall be to the
satisfaction of the City Planning Department.
6. Staff will not require a block wall separating the M-1 from the R-2
zone as set forth in Section 9122.13 of the Rosemead Municipal Code for
the reason that it will isolate the owners' R-2 zoned property. Staff
feels that it is sufficient at this time to only require wheel stops
along this property line.
7. Parking area shall be provided with one 500-watt light directed away
from residential zone to_illuminate the parking lot.
8. The storage located to the rear of the liquor store shall be cleaned
and maintained free of trash, litter and debris.
9. Comply with Section 5401 through 5415 which deals with the storage,
collection, accumulation and disposal of garbage, rubbish, trash and
debris. /
10. The existing chain-link fence along the east property line that is in a
state of disrepair and falling down, is to be completely removed.

11. The landscaping that is adjacent to the structure along Garvey
Avenue is to be cleaned and maintained free of trash and debris.
12. The structure shall remain free of graffiti at all times.
13. This conditional use permit is approved for a period of two (2)
years, at which time it may be renewed by the Planning Commission
without a public hearing. This permit is not transferable to future
purchasers or occupants. The applicants assume responsibility for
all conduct on the premises.
14. Within ten (10) days after approval, the applicant shall submit a
notarized Affidavit of Agreement to the above conditions with the
Planning Department and within one (1) year, (with the exception of
Condition No. 3), satisfy these conditions with the knowledge that
failure to do so may result in the revocation of this permit.
Section 5. This action shall become final and effective the (10) days
after this decision by the Planning Commission unless within such time a written
appeal is filed with the City Clerk for consideration by the Rosemead City Council
as provided in the Zoning Ordinance.
Section 6. The secretary shall certify to the adoption of the Resolution
and shall transmit copies of same to the applicants and the Rosemead City Clerk.
