PC - 1979-40 - Granting Conditional Use Permit 79-163PC RESOLUTION 79-40 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT NO. 79-163. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Ted and Hedy Orden, doing business as Thrifty Oil Company, to request compliance with Section 9184 et. seq. of the Rosemead Municipal Code, standards for automobile service stations, for a service station located at: 3302 Del Mar Avenue, Rosemead, California; and that a public hearing was duly set for October 15, 1979, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, place and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et. seq. of the Ordinances of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. Based on the aforementioned findings, the Commission hereby grants a conditional use permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Landscaping must be installed in the area designated on the plot plan. 2. All structures on the property must be removed of graffiti and be kept free of graffiti as long as the station is being operated. 3. Enclose the trash container. Such trash enclosure must be approved by the Planning Department. 4. The applicant agrees to maintain the property in a clean and litter- free state. 5. Within ten (10) days of the approval of this Conditional Use Permit, the applicant shall sign a notarized Affidavit of Agreement with the above conditions and agree to implement the necessary conditions within thirty (30) days. 6. This Conditional Use Permit is not transferable and is approved for a period of three (3) years or until transfer should take place, at which time the new owner would be required to renew this permit. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 5th day of November 1979.
