PC - 1979-39 - Granting Conditional Use permit 79-158PC RESOLUTION 79-39 Cl A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 79-158. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was filed by Joseph Rutana to request compliance with Section 9184 et. seq. of the Rosemead Municipal Code, standards for automobile service stations, for a service station located at: 3363 Del Mar Avenue, Rosemead, California; and that a public hearing was duly set for October 1, 1979, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, place, and purpose of the aforesaid hearing was duly given, and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et. seq. of the Ordinances of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Both trash bins on the site to be enclosed with location and type of enclosure to be approved by the Planning Director. 2. Provide decorative screening at outside entrances to restrooms-- minimum of six (6) feet high with bottom of screen open 12" to 18". 3. All car repair shall be done within the service bays. 4. Applicant will keep the station site in a clean and litter-free state. 5. Applicant will install a landscaped area per the attached plot plan. 6. Restripe parking stalls adjacent to the meat market. 7. No sale, display, advertising for sale of automobiles, trucks or trailers. 8. No storage of vehicles other than that incidental to the business. 9. No vehicles to be parked on sidewalks, parkways, driveways, or planting areas. 10. Comply with the requirements of the Building/Fire Departments. 11. Maintain restrooms in a clean and sanitary manner. 12. This Conditional Use Permit is not transferable and is approved for a period of three (3) years or until transfer should take place, at which time the new owner would be required to renew this permit. 13. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement with the Planning Department. 0 Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 15th day of October , 1979.
