PC - 1979-35 - Granting a conditional use permit in conditional use permit case 79-161PC RESOLUTION 79-35 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE No. 79-161. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was filed by Refugio and Enriquetta Ruiz to request the sale of beer with meals in conjunction with an existing restaurant, known.as "The Golden Flame", located at: 7755 East Garvey Avenue, Rosemead, California; and that a public hearing was duly set for September 4, 1979, at 7:30 p.m. in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given; and that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et. seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Apply for a City of Rosemead Business License and Occupancy Permit. All herein must be completed with prior to the issuance of said permits. 2. Comply with the requirements of the Building, Fire and Health Depart- ments. 3. This Conditional Use Permit is approved for a two-year period, at which time it may be reviewed by the Planning Commission without a Public Hearing. This permit is not transferable to future pur- chasers or occupants. The applicants assume responsibility for all conduct on the premises. 4. Supply trash containers and maintain the property in a clean and litter-free state. 5. Remove debris at rear of structure. 6. Repair the depressions in the parking lot and restripe the parking lot within six (6) months of approval of this Conditional Use Permit. 7. Install a new chain-link fence along rear property line and provide said fence with view-obscuring.strips inter-woven into chain link within six (6) months of approval of this Conditional Use Permit. 8. Beer shall be sold only with meals. 9. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement to these conditions with the Planning Department. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk.for consideration by,the Rosemead City Council as provided in the Zoning Ordinance. r~ L Section 6. The secretary shall certify to the adoption of the Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this 17th day of September 1979.
