PC - 1979-25 - Granting Conditional Use Permit in Conditional use permit case 79-149PC RESOLUTION 79-25 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE 79-149. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Raul Naranjo, for the sale of alcoholic beverages with respect to real property described as: 9322 Valley Boulevard, Rosemead, and that a public hearing was duly set for June 4, 1979 at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et seq. of the ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Metal stripping to be incorporated into the chain link fence (missing portion) along the west property line. 2. The door to remain closed at all times during the hours of operation. 3. Landscaping along Valley Boulevard to be better maintained. 4. Maintain the property in a clean, litter-free state. 5. Replace missing exterior light bulbs. 6. It is agreed by the applicant that the Rosemead Planning Department may make periodic inspections of the facilities. 7. This Conditional Use Permit is approved for a period of two years, at which time it may be reviewed for renewal by the Planning Commission without a public hearing. This permit is not transferable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 8. within ten (.10) days after approval, the applicant shall submit a notarized affidavit of agreement to the conditions to the Planning Department. expressly conditioned upon Mr. Naranjo's continued responsibility for the operation of the business. 9. Because the owner of the business is out of the jurisdiction and because Raul Naranjo has satisfactorily operated the business for approximately two (2) years, this permit is Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the zoning ordinance. Section 6. The Secretary shall certify to adoption of same to the this Resolution and shall transmit copies applicant and the Rosemead City Clerk.
