PC - 1979-24- Granting conditional use permit in conditional use permit case no. 79-148• • ' PC RESOLUTION 79-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD,GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 79-148. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Jose Mercado, with respect to real property described as set forth in exhibit "A"; requesting the establishment of a wholesale nursery; and that a public hearing was duly set for June 4, 1979 at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the afore- said hearing was duly given; that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et.seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings the Commission hereby grants a Conditional Use Permit with respect to the property as set forth in exhibit "A" subject to the following conditions: 1. Applicant shall apply for all appropriate City Business Licenses. 2. This Conditional Use Permit shall not be deemed valid until such time the City is in possession of a copy of the lease agreement between the applicant and the Southern California Edison Company. 3. Applicant shall provide a 20 foot drive-and curb cut to serve the subject site. 4. This permit is approved for a period of three (3).years, at which time the applicant may apply for renewal by the Planning commission without a public hearing. This permit is not transferable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 5. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement to these conditions with the Planning Department. 6. A development plan to be submitted to the planning department for approval showing the following: potting and compost areas, access drive, drain area, type and placement of security fencing. • 7. All spraying of insecticides be restricted to the northwest corner of the property. 8. The applicant will be required to pave the drive from Angelus Street into the growing area for dust control. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead City Clerk. ADOPTED this 18 day of June 1979.
