A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD
GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT
CASE NO. 79-147, 3223-DEL MAR AVENUE, ROSEMEAD, CALIFORNIA.
THE.PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The Planning Commission does hereby find and determine
that an application was duly filed by Zaid Assfy for United Islamic Youth
organization, with respect to real property described as:
3223 Del Mar Avenue, Rosemead, California
requesting the establishment of an Islamic temple for the purpose of religious
worship; and that a public hearing was duly set for May 21, 1979 at 7:30 p.m.
in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard,
Rosemead, California, and that notice of the time, date, place and purpose
of the aforesaid hearing was duly given; that a hearing was duly held at the
aforementioned time and place.
Section 2. The Planning Commission further finds and determines that
facts do exist as required by Section 9180 et seq. of the ordinances of the City
of Rosemead justifying a granting of the Conditional Use Permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives
of the City's General Plan.
2. The project will not be detrimental to the surrounding properties.
3. The project is desirable for the public convenience.
Section 4. Based on the aforementioned findings, the Commission hereby
grants a Conditional Use Permit with respect to the property described in Section
1 of this Resolution, subject to the following conditions:
1. Applicant to execute an irrevocable offer to dedicate five (5)
feet for improvement of right of way on Del Mar Avenue.
2. Applicant waives any right to the conduct of Bingo games on the
premises during the life of the permit.
3. Applicant will submit to the Planning Department a,bi-monthly progress
report as to the compliance with all the conditions.
4. Applicant shall apply for an Occupancy Permit and comply with all
requirements of the Building Department prior to public use.
5. The applicant shall submit to the Planning Department a precise
parking plan, and meet all the requirements of Section 9122.13 of
the Rosemead Municipal Code.
6. The existing delapidated structure in the rear yard shall be
removed.
7. Comply with Section 5401-5415 of the Rosemead Municipal Code, which
deals with the storage, collections, accumulation and disposal of
garbage, trash, rubbish and debris.
8. This Conditional Use Permit shall expire one (1) year from the
date of issuance. The owner shall be entitled to an extension,
if the Director of Planning finds the proposed use to be in con-
formity with the goals and purposes of Rosemead municipal code
Section 9181 (last paragraph). Such extension shall be granted
in accordance with Rosemead Municipal Code Section 9183.2.
9. Within five (5) days after approval of this Conditional Use Permit,
applicant shall submit a signed, notarized "Affidavit of Acceptance
of Conditions" to the Planning Department accepting the foregoing
conditions.
Section 5. This action shall become final and effective ten,(10)
days after this decision by the Planning Commission unless within such time a
written appeal is filed with the City Clerk, for consideration by the Rosemead
City Council as provided in the Zoning Ordinance.
Section 6. The Secretary shall certify to the adoption of this
Resolution and shall transmit copies of the same to the applicant and the
Rosemead City Clerk.
