PC - 1979-20 - Granting a Conditional Use permit in Conditional use permit case 79-146PC Resolution,79-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 79-146, 3247 SAN GABRIEL BOULEVARD, ROSEMEAD, CALIFORNIA. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly.filed by Arnulfo Contreras, 3247 San Gabriel Boulevard, Rosemead, with respect to real property described as: 3247 San Gabriel Boulevard, Rosemead requesting the on-site sale of beer and wine in conjunction with an existing restaurant; and that a public hearing was duly set for May 7, 1979 at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead California, and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: The project is in harmony with the elements and objectives of the City's General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based,on the aforementioned findings, the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1. Applicant shall apply for all appropriate City Business License and Occupancy Permit. All conditions herein must be complied with before issuance of said permits. 2. Comply with the requirements of the Building and Fire Departments. 3. Supply trash containers and maintain the property in a clean and litter free state. 4. This Conditional Use Permit is approved for a six (6) month period, at which time it may be reviewed by the Planning Commission without a public hearing. This permit is not transferabler:. to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 5. Remove Existing chain link fence surrounding parking area and install six (6) foot high concrete block wall. 6. Stripe required number of-parking spaces per Planning Director's recommendation. 7. Doors to remain closed during hours of operation. 8. Remove storage room on the north side of the restrooms. 9. Within ten (10) days after approval, the applicant shall submit a notarized affidavit of agreement to the conditions to the Planning Department. 10. Remove freezer and all junk in the parking lot. 11. All beer shall be sold in conjunction with food. Section 5. This action shall become final and effective ten 10 days sfter this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead City Clerk. ADOPTED this 21 day of May, ROBERT 0.
