PC - 1979-19 - Granting a Conditional Use permit in conditional use permit case 79-143PC Resolution 79-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE 79-143, 8953 VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Sanuel & Lorraine Villabisencio with respect to real property described as: 8954 Valley Boulevard, Rosemead, California requesting the off-site sale of alcoholic beverages; and that a public hearing was duly set for May 7, 1979 at 7:30 p.m. at the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and that notice of the time, date, place and purpose of the aforesaid hearing was duly held at the afore- mentioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the City's General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject to the following conditions: 1 2. 3. 4. Apply for the appropriate City Business License and Occupancy Permit. Any available off-street parking spaces be re-striped. Comply with the requirements of the Building, Fire and Health Departments. Supply City-approved trash containers and maintain the property in a clean and litter free state. 5. This Conditional Use Permit is approved for a two (2) year period, at which time it may be reviewed for renewal by the Planning Commission without Public Hearing. This permit is not transferrable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 6. Within ten (10) days after approval, the applicant shall submit a notarized affidavit of agreement to these conditions with the Planning Department. 17J 0 Section 5. The action shall become final and effective ten 10 days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead-City Clerk. ADOPTED this 21 day of May, 1979.
