PC - 1979-18 - granting Conditional Use Permit case no. 79-144PC RESOLUTION 79-18-- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE NO. 79-144, 9766 VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS:- Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Frank Santana with respect to real property described as: 9766 E. Valley Boulevard, Rosemead, California requesting the arcade use in conjunction with an existing family billard parlor; and that a public hearing was duly set for May 7,1979 at 7:30 p.m. at the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California and that notice of the time, date, place, and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned times and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable for the public convenience. Section 4. Based on the aforementioned findings the Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1 of this Resolution, subject,to the following--conditions: 1. Applicant shall apply for all appropriate City Business Licenses and Occupancy Permits. 2. This Conditional Use Permit shall expire in two (2) years from the date of issuance except that the owner shall be entitled to a two (2) year extension, if the Director of Plannin finds the Applicant's operation to be in conformity with the goals and purposes of Rosemead Municipal Code Section 9181(last paragraph). Such extension shall be granted in accordance with Rosemead Municipal Code Section 9181.2. 3. This permit is granted for twelve (12) arcade machines only. 4. Within five (5) days after approval of this Conditional Use Permit, Applicant shall submit a notarized Affidavit of Acceptance of Conditions to the Planning Department. i Section 5. This action shall become final and effective ten 10 days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary ,shall certify to the adoption of this Resolution and shall transmit copies of the same to the applicant and the Rosemead City Clerk. ADOPTED this 21 day of May, 1979.
