A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSE-
MEAD GRANTING A CONDITIONAL USE PERMIT IN CASE NO. 79-145.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find and determine
that an application was duly filed by Sharon Fuller and Shirley Florence,
with respect to real property described as follows:
8611 East Valley Boulevard, Rosemead, California;
requesting the sale of antiques at the above address, which is in the
C3-D Zone; that a Public Hearing was duly conducted on April 16, 1979, at
7:30 p.m., in the Council Chambers of the Rosemead City Hall, 8838 Valley
Boulevard, Rosemead, California; and that notice of time, date, place and
purpose of the aforesaid hearing was given according to law.
Section 2. The Planning Commission further finds and determines
facts do exist as required by Section 9180 et. seq. of the Ordinances of
the City of Rosemead justifying a granting of the Conditional Use Permit.
Section 3. The Planning Commission further finds:
1., Compliance with the Conditions of Approval will insure that
the project will not be detrimental to the surrounding pro-
perties.
2. The project is desirable to the public convenience.
3. The proposed use is in conformance with the General Plan.
4. As the internal operation will not create objectionable noise
or odors, the proposed project should be compatible with
surrounding development.
5. The application has been determined to be categorically
exempt within the definition of Section 15101 of the Guide-
lines for the Implementation of CEQA.
Section 4. Based on the aforementioned findings, the Commission
hereby grants a Conditional Use Permit with respect to the property described
in Section 1 of this Resolution subject to the following conditions:
1. Applicants shall obtain City of Rosemead Business license
and Occupancy Permit and comply with the requirements of these
departments.
2. All items.not considered new, boutique, cards or gifts shall
be bona fide antiques subject to the definition of Section
9102.57 of the Rosemead Municipal Code.
3. Signs shall meet the requirements of the C-3 Zone.
4. This Conditional Use Permit shall expire in two (2) years from
the date of issuance except that the owner shall be entitled
to a two (2) year extension, if the Director of Planning finds
the Applicant's operation to be in conformity with the goals
and purposes of Rosemead Municipal Code Section 9183.2.
5. Within five (5) days after approval of this Conditional Use
Permit, Applicants shall submit a signed, notarized "Affidavit
of Acceptance of Conditions" to the Planning Department.
6. This Conditional Use Permit shall be a personal permit issued
to Sharon Fuller and Shirley Florence and shall not be
assignable voluntarily or involuntarily and shall terminate upon
assignment or upon the cessation of business by Sharon Fuller
and Shirley Florence at the location described herein.
7. All display of merchandise for sale on the premises shall be
wholly enclosed with the building.

8. A sign must be posted at the rear of the shop designating
three (3) parking spaces as antique shop parking only.
Section 5. This action shall become final and effective ten (10)
days after this decision by the Planning Commission unless within such time a
written appeal is filed with the City Clerk, for consideration by the Rose-
mead City Council as provided in the Zoning Ordinance.
Section 6. The Secretary shall certify to the adoption of the
Resolution and shall transmit copies of the same to the Applicant and Rose-
mead City Clerk.,
