RESOLUTION 93-62
OF THE PLANNING COMMISSION OF
ROSEMEAD GRANTING APPROVAL OF
93-262 FOR PROPERTY LOCATED AT
JENUE, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find
and determine that an application was filed by Wellington Soo Hoo to
allow a five (5) foot second story sideyard setback in lieu of the
required ten (10) foot side yard and a ten (10) foot rear yard
setback in lieu of the required twenty (20) foot rear yard setback in
order to legalize and complete an existing dwelling for property
located at:
3322 Jackson Avenue,
and that a public hearing was duly scheduled for December 20, 1993,
at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838
Valley Boulevard, Rosemead, California; and that notice of the time,
date, place and purpose of the aforesaid hearing was duly given; and
that a public hearing was duly held at the aforementioned time and
place.
Section 2. The Planning Commission further finds that
facts do exist as required by Section 9171, et seq. of the Rosemead
Zoning Code, justifying the granting of a zone variance.
Section 3. The Planning Commission further finds:
1. That the granting of such variance will not be
detrimental to the public health or welfare, or
injurious to the property and improvements.
2. That because of special circumstances applicable to the
subject property, the strict application of the zoning
ordinance would place an undue hardship on the
property/project.
3. Based on an environmental study, the proposed project
qualifies for a Categorical Exemption under the
provisions of CEQA.
Section 4. Based on the aforementioned findings, the
Planning Commission hereby grants the zone variance with respect to
the property described in Section 1, subject to the conditions
contained within the attached Exhibit "A".
Section 5. This action shall become final and
effective ten (10) days after this decision by the Planning
commission unless within such time, a written appeal is filed with
the City Clerk for consideration by the City Council as provided in
the Zoning Ordinance.

CONDITIONS OF APPROVAL
DECEMBER 20, 1993
1. This zone variance approval shall expire after one (1) year that
there is no progress towards completion of the authorized use.
2. The applicant shall sign a notarized affidavit agreeing to these
conditions within ten days of approval.
3. The conditions listed on this Exhibit shall be copied directly
onto development plans submitted to the Planning and Building
Departments for review.
4. The property shall be developed in accordance with the plans,
(marked Exhibit B) except where otherwise noted. Any
modification shall require prior Planning Department approval.
5. The property shall comply with all appropriate Building, Fire,
and Health Department regulations.
6. The property shall be kept cleared of weeds, debris and abandoned
vehicles, and maintained pursuant to the County Fire and Health
codes until it is developed. Surplus construction materials shall
be stored so as to be screened from public view when not actually
in use.
7. Construction activities shall be limited to take place between
the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No
construction shall take place on Sundays or on any legal
holidays.
8. No windows with a lower sill less than 5.5 feet from the finished
floor level shall be allowed along the second story side setback
(south side only).
9. The existing carport on the front dwelling unit shall be removed
and a new two-car garage shall be constructed as shown on the
plans (marked Exhibit B).
10. The existing front unit shall be repainted and rehabilitated to
the satisfaction of the Director of Planning.
