PC - 1993-62 - Granting Approval of Zone Variance 93-262 for 3322 Jackson AvePC A RESOLUTION THE CITY OF ZONE VARIANCE 3322 JACKSON A' RESOLUTION 93-62 OF THE PLANNING COMMISSION OF ROSEMEAD GRANTING APPROVAL OF 93-262 FOR PROPERTY LOCATED AT JENUE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was filed by Wellington Soo Hoo to allow a five (5) foot second story sideyard setback in lieu of the required ten (10) foot side yard and a ten (10) foot rear yard setback in lieu of the required twenty (20) foot rear yard setback in order to legalize and complete an existing dwelling for property located at: 3322 Jackson Avenue, and that a public hearing was duly scheduled for December 20, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds that facts do exist as required by Section 9171, et seq. of the Rosemead Zoning Code, justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of such variance will not be detrimental to the public health or welfare, or injurious to the property and improvements. 2. That because of special circumstances applicable to the subject property, the strict application of the zoning ordinance would place an undue hardship on the property/project. 3. Based on an environmental study, the proposed project qualifies for a Categorical Exemption under the provisions of CEQA. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants the zone variance with respect to the property described in Section 1, subject to the conditions contained within the attached Exhibit "A". Section 5. This action shall become final and effective ten (10) days after this decision by the Planning commission unless within such time, a written appeal is filed with the City Clerk for consideration by the City Council as provided in the Zoning Ordinance.
