A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF
TENTATIVE PARCEL MAP 23864 AND MODIFICATION OF
CONDITIONAL USE PERMIT 92-573 FOR PROPERTY LOCATED
AT 7833 & 7839 EMERSON PLACE, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission of the City of
Rosemead does hereby find and determine that an application was duly
filed by Godakalana Gunaratana to consolidate two parcels into one to
facilitate development of a library/meeting room addition for an
existing temple located at:
7833 & 7839 Emerson Place,
or more specifically known as:
CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA,
BEING A SUBDIVISION OF A PORTION OF LOT 3, AS PER MAP RECORDED IN
BOOK 20, PAGE 134-135 OF MAPS, IN THE OFFICE OF THE COUNTY
RECORDER OF SAID COUNTY,
and that a public hearing was duly scheduled for October 4, 1993, at
7:00 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley
Boulevard, Rosemead, California; and that notice of the time, date,
place, and purpose of the aforesaid hearing was duly given according
to law; and that a public hearing was duly conducted at the
aforementioned time and place.
Section 2. The Planning Commission further finds and
determines that this request is in conformance with the Land Use
Element of the General Plan, and;
1. The proposed map is consistent with the applicable General
Plan of the City of Rosemead,
2. The design of the proposed subdivision and improvements is
consistent with the applicable General Plan. There is no
specific plan.
3. The site is physically suitable for the type of development.
4. The site is suited for the proposed density of development.
5. The design of the subdivision will not conflict with public
easements.
6. The design and proposed improvements of the subdivision
will have no significant adverse effects on the environment,
and, therefore, a Negative Declaration was prepared and
adopted in compliance with Rosemead Resolution 79-77, CEQA,
and the guidelines for the implementation of CEQA.
7. Discharge of wastes from the proposed subdivision will not
result in the violation of existing requirements as
prescribed by the California Regional Water Board.
Section 3. NOW, THEREFORE, BE IT RESOLVED that the
Planning Commission of the City of Rosemead does approve the request
for the Tentative Tract Map described in Section 1, subject to the
conditions contained in the attached Exhibit "A".

This action shall become final and effective ten (10) days after this
decision by the Planning Commission, unless within such time, a
written appeal is filed with the City Clerk for consideration by the
Rosemead City Council, as provided in the Zoning Code.
Section 5. The secretary shall certify to the adoption
of this resolution and transmit copies thereof to the City Clerk of
the City of Rosemead.
Section 6. This resolution is the result of an action
taken by the Planning Commission on October 4, 1993, by the following
vote:

CONDITIONS OF APPROVAL
OCTOBER 5, 1993
1. The following conditions must be. complied with to the
satisfaction of the Director of Planning, prior to final approval
of associated maps, building permits, occupancy permits, or any
other appropriate request.
2. The applicant shall sign a notarized affidavit agreeing to these
conditions within ten days of approval.
3. The conditions listed on this Exhibit shall be copied directly
onto development plans submitted to the Planning and Building
Departments for review.
4. The property shall be developed in accordance with the plans
dated 9-30-93 (marked Exhibit C), except where otherwise noted.
Any modification shall require prior Planning Department
approval.
5. The property shall comply with all appropriate Building, Fire,
and Health Department regulations.
6. Adequate lighting shall be provided in the parking area.
Motion-activated lights shall be installed where deemed
appropriate by the Director of Planning. All exterior lighting
shall be directed away from adjacent properties.
7. The property shall be kept cleared of weeds, debris and abandoned
vehicles, and maintained pursuant to the County Fire and Health
codes until it is developed. All trash shall be contained in
dumpsters and removed on an as-needed basis. No trash shall be
visible from outside the dumpster. Surplus construction
materials shall be stored so as to be screened from public view
when not actually in use.
8. Construction activities shall be limited to take place between
the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No
construction shall take place on Sundays or on any legal
holidays.
9. A 61-high fence, composed of chain link or other approved
material, shall totally enclose the perimeter of the property
when vacant, under construction, or under demolition, and said
fence shall remain until Occupancy is granted.
10. The easterly and northerly perimeter property line of the project
shall be fenced with a six-foot (61) high masonry wall, with
finished surface on both sides, to the discretion of the Planning
Director.
11. All utilities shall be underground including appropriate wiring
for cable television. The underground conversion of these
utilities shall consider all future connections, including any
necessary connections to the Margaret Duff school, to the
satisfaction of the Director of Planning.
12. A detailed landscaping/irrigation plan shall be submitted
together with development plans.
13. The applicant shall obtain a Certificate of occupancy permit
prior to beginning operations.
14. The existing garage doors shall be altered to allow sufficient
access to the garages from the proposed easterly driveway,
subject to the approval of the Director of Planning.
15. The property shall be developed in accordance with Parcel Map
23864 dated 9-7-93; marked Exhibit "B", and approved by the
Planning commission on October 4, 1993.
16. The project shall comply with the conditions as set forth in the
City Engineer's report dated 9-15-93, and the L.A. County Fire
Department's requirements. All conditions shall be completed to
the City Engineer's and Director of Planning's satisfaction prior
to recordation of the final map.
17. This map shall be finaled and recorded within two (2) years of
tentative approval. Failure to do so may result in the map's
expiration and the need for another tentative map application.
Any request for extension must be submitted, in writing, together
with ten (10) copies of the map and corresponding plans, to the
Planning Department before the expiration date.
18. The numbers of the address signs shall be at least 6" tall with a
minimum character width of 1/411, contrasting in color and easily
visible at driver's level from the street. The location, color
and size of such sign shall be subject to the approval of the
Planning Director.
19. Eliminate the existing property line shown on the tentative
parcel map which currently divides the lot into two lots and
designate the proposed lot as "Lot 1."
20. The maximum occupancy load of the sanctuary shall not exceed 65
persons.
21. The existing eucalyptus trees shall be saved and incorporated
into permanent landscape planters and included into the required
landscape plan, to the discretion of the Planning Director.
