PC - 1993-35 - Granting Conditional Use Permit 93-591• PC RESOLUTION 93-35 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 93-591 ALLOWING THE TRANSFER OF AN EXISTING LIQUOR LICENSE FOR PROPERTY LOCATED AT 8150 E. GARVEY AVENUE, ROSEMEAD. THE PLANNING. COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by T&T Supermarket to transfer an existing ABC license for the sale of alcoholic beverages at: 8150 E. Garvey Avenue, and that a public hearing 7:00 p.m. in the Council Valley Boulevard, Rosemead, and purpose of the aforesaid and that a public hearing time and place. was duly scheduled for June 21, 1993, at Chambers of the Rosemead City Hall, 8838 ind that notice of the time, date, place, hearing was duly given according to law; was duly conducted at the aforementioned Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on June 21, 1993, by the following vote: YES: Lowrey, Ruiz, Young, Breen, Ortiz NO : None ABSENT: None ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 6th day of July, 1993. ROBERT K. YOUNG, CHAIRMAN EXHIBIT A CONDITIONAL USE PERMIT 92-591 T&T SUPERMARKET - 8150 GARVEY AVENUE #121 CONDITIONS OF APPROVAL JUNE 24, 1992 1. The conditional use permit is approved for one (1) year, at which time it shall be reviewed by the Planning Commission for an extension. The occupant shall file a request for extension at least 30 days before expiration with the Planning Department. 2. The project shall be developed as shown on the plans, stamped Exhibit B and dated 6-14-93, except where noted otherwise. Any modification of this plan shall require approval by the Planning Department. 3. The applicant shall obtain a City of Rosemead Business License and "Certificate of Occupancy" prior to beginning business operations. 4. Comply with the requirements of the Building, Fire, and Health Departments. 5. Signs shall comply with Section 9900-9908 of the Rosemead Municipal Code. Signs shall not cover more than 25% of building area or 15$ of window area. 6. The site shall be maintained in a clean, weed and litter free state in accordance with Section 5401-5415 of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection and disposal of garbage, rubbish, trash and debris. All trash containers be stored in the appropriate trash enclosure. 7. The site shall be maintained in a graffiti-free state. Any new graffiti shall be removed within twenty-four (24) hours. 8. Applicant shall post signs stating "no consumption of alcoholic beverages on premises", or containing similar language, on all sides of the building, subject to approval by the Planning Department. 9. The applicant shall maintain adequate lighting in the parking area. Lighting shall be directed away from nearby residential area. Motion-activated lights shall be installed where deemed necessary by the Planning Director. 10. The applicant shall obtain the appropriate license from the Department of Alcoholic Beverage Control. 11. The liquor and tobacco display shall be located in an area which will reduce the potential for crime and theft. 12. Within ten days after approval, the applicant shall submit a notarized affidavit of agreement to all conditions.
