PC - 1993-24 - Granting Conditional Use Permit 93-585PC RESOLUTION 93-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 93-585 TO ALLOW TRANSFER OF AN EXISTING ABC LICENSE FOR THE ON-SITE SALE OF BEER AT 9322 E. VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Delores Jane Denley to transfer an existing ABC license for the on-site sale of beer in conjunction with an existing restaurant/tavern dba Beef Cellars (Critters) located at: 9322 E. Valley Boulevard and that a public hearing was duly scheduled for April 19, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Class 9 Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions. contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days. after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on April 19, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Breen, Young NO : None ABSENT: None ABSTAIN: None Section 8. ER, SEC 7Y • EXHIBIT A CONDITIONAL USE PERMIT 93-585 9322 E. VALLEY BOULEVARD - BEEF CELLARS CONDITIONS OF APPROVAL APRIL 19, 1993 1. Applicant shall apply for all business licenses and an occupancy Permit. 2. The parking lot shall be maintained with eight spaces with wheel stops and double striping. 3. The front panel of building shall be maintained to the satisfaction of the Planning Director including the removal of all graffiti. 4. The front and side door shall remain closed at all times. 5. The security light at the rear and side entrance shall be maintained to the satisfaction of the Planning Director. 6. The seating capacity shall be limited to 32 maximum. 7. The property shall be cleaned of weeds and debris within one month and the landscaped areas shall be maintained in accordance with Section 5401-5414 of the Rosemead Municipal Code. 8. The conditional use permit be granted for a period of one (1) year, at the end of which time it may be reviewed for an extension by the Planning Commission without a public hearing. The applicant shall file a request to extend Conditional Use Permit 93-585 thirty (30) days prior to its expiration with the Planning Department. 9. The applicant shall comply with Ordinance No. 567 which requires the posting of a sign prohibiting consumption of alcoholic beverages in parking lots and public sidewalks adjacent to the premises. 10. The applicant shall repair and maintain the rear block wall. 11. All conditions shall be met thirty (30) days from approval of this conditional use permit. 12. No off-site sales of alcohol shall be permitted. 13. Within ten days after approval, the applicant shall sign a notarized affidavit of agreement to the conditions and return it to the Planning Department. SCUP585
