A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE
PERMIT 93-582 TO ALLOW CONTINUED OPERATION OF
A KARAOKE (KTV) STUDIO LOCATED AT 9151 E.
VALLEY BOULEVARD, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission of the City of
Rosemead does hereby find and determine that an application was duly
filed by Gene Feng to continue the operation of a karaoke (KTV)
studio dba KISS KTV located at:
9151 E. Valley Boulevard,
and that a public hearing was duly scheduled for April 5, 1993, at
7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838
Valley Boulevard, Rosemead, and that notice of the time, date, place,
and purpose of the aforesaid hearings was duly given according to
law; and that a public hearing was duly conducted at the
aforementioned time and place.
Section 2. The Planning Commission further finds and
determines that facts do exist as required by Section 9181, et seq.
of the Ordinance of the City of Rosemead justifying the granting of a
Conditional Use Permit.
Section 3. The Planning commission further finds:
1. The project is in harmony with the elements and objectives
of the General Plan.
2. The project will not be detrimental to the surrounding
properties.
3. The project is desirable to the public convenience.
Section 4. On the basis of evaluation, this project has been
determined to qualify for a Categorical Exemption under the
provisions of the California Environmental Quality Act.
Section 5. Based on the above findings, the Planning
Commission hereby grants a Conditional Use Permit for property
described in Section 1, subject to the conditions contained within
the attached Exhibit A.
Section 6. This action shall become final and effective ten
(10) days after this decision by the Planning Commission, unless
within such time a written appeal is filed with the City Clerk for
consideration by the Rosemead City Council as provided in the Zoning
Ordinance.
Section 7. This resolution is the result of an action taken
by the Planning Commission on April 5, 1993, by the following vote:
YES: Lowrey, Ruiz, Ortiz, Breen, Young
NO : None
ABSENT: None
ABSTAIN: None
Section 8. The secretary shall certify to the adoption of
this Resolution and shall transmit copies of same to the applicant
and Rosemead City Clerk.

CONDITIONS OF APPROVAL
APRIL 6, 1993
1. No alcoholic beverages to be served or allowed on the premises at
any time. A sign reading "NO Alcoholic Beverages Permitted" in
lettering no less than four inches (411) in height and printed in
English, Chinese, Cantonese or Mandarin, and Spanish shall be
conspicuously posted at no less than two (2) locations inside the
business. One such sign shall be posted at the registration/
reservation area. In addition, no less than two (2)
international symbol "No Drinking" signs shall be conspicuously
posted at different locations inside the business-establishment.
2. No person, other than bonafide employees, may occupy premises
between 3:00 a.m. and 8:00 a.m.
3. All doors to Karaoke rooms shall remain unlocked and be incapable
of being locked. The doors will have a minimum twenty-four inch
(2411) wide by thirty-six inch (3611) high window in the upper half
of the door. Each individual karaoke room shall contain at least
one (1) other window as well. Full and unobstructed viewing into
the room shall be maintained at all times.
4. The exterior door to each individual karaoke room shall contain a
conspicuously posted sign indicating the rated occupancy of the
room pursuant to the Fire Code.
5. No persons under eighteen (18) years of age shall be allowed on
the premises after 10:00 p.m., unless accompanied by a parent or
legal guardian.
6. The owner is responsible for maintaining a permanent register of
all patrons by having each patron sign the register before
allowing the use of a Karaoke room. The owner or his/her
employee shall verify the identity of the patron by checking the
patron's identification and legibly listing the full name of the
patron in the register.
7. The owner of the establishment.shall be strictly accountable for
compliance with each condition imposed, whether or not the owner
is personally present at the studio.
8. The studio shall adhere to the City's Noise Ordinance provisions
as set forth in Section 4300 et. seq. of the RMC.
9. Non-conforming properties shall achieve conforming status before
becoming eligible for KTV studio use.
10. Off-street parking shall be provided as set forth in section
9122.8 of the RMC.
11: The applicant shall sign a notarized affidavit agreeing to these
conditions within ten days of approval.
12. The property shall be developed in accordance with the site plan
dated 2-1-91, marked Exhibit B, and the Floor Plan, dated 9-6-91,
marked Exhibit C except where otherwise noted. Any modification
shall require prior Planning Department approval.
13. The property shall comply with all appropriate Building, Fire,
and Health Department regulations.

14. Adequate lighting shall be provided in the parking area. Motion-
activated lights shall be installed where deemed appropriate by
the Director of Planning. All exterior lighting shall be
directed away from adjacent properties.
15. The site shall be maintained in a clean, weed and litter-free
state in accordance with Sections 5401-5415 of the Rosemead
Municipal Code, which pertains to the storage, accumulation,
collection and disposal of garbage, rubbish, trash and debris.
All trash containers shall be stored in the appropriate trash
enclosure.
16. This conditional use permit is
