PC - 1993-16 - Granting Conditional Use Permit 93-579• PC RESOLUTION 93-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 93-579 TO TRANSFER AN EXISTING ABC LICENSE AT 8810-12 E. GARVEY AVENUE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Zoila De Lemus to transfer an existing ABC license for the off-site sale of beer and wine in conjunction with a market dba Tonia's Market for property located at: 8810-12 E. Garvey Avenue, and that a public hearing was duly scheduled for 7:00 P.M. in the Council Chambers of the Rosem Valley Boulevard, Rosemead, and that notice of the and purpose of the aforesaid hearings was duly law; and that a public hearing was duly aforementioned time and place. March 15, 1993, at Bad City Hall, 8838 time, date, place, given according to conducted at the Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a class 9 Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on March 15, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Breen, Young NO : None ABSENT: None ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 5th day of April, 1993. ROBERT-K.-YOUNG, C IA~~ EXHIBIT A CONDITIONAL USE PERMIT 93-579 8812 GARVEY AVENUE - AMERICA'S MARKET CONDITIONS OF APPROVAL MARCH 16, 1993 1. Applicant shall maintain a City of Rosemead Business License and Occupancy Permit and satisfy all the requirements of Building and Safety, Health and Fire Department. 2. All trash shall be stored, and property maintained in accordance with Section 5401-5415 of the Rosemead municipal code. The existing trash enclosure shall have metal doors as specified by the City of Rosemead. 3. All signs shall be in accordance with Section 9900-9913 of the Rosemead Municipal Code. Signs shall not cover more than 25% of building area or 15% of window area. 4. This conditional use permit is approved for a period of six (6) months, at which time it may be reviewed for an extension without benefit of a public hearing. 5. Applicant shall comply with Ordinance No. 567 of the Rosemead Municipal Code which requires the posting of licensed premises prohibiting the consumption of alcoholic beverages in parking lots and public sidewalks immediately adjacent to the licensed premises. 6. The front and rear facades shall be painted and maintained clean at all times and all graffiti shall be promptly removed. All new graffiti shall be removed within 24 hours. 7. A sign must be posted indicating the hours of operation. 8. The applicant shall move display racks and merchandise so that the windows are not obstructed from street view within seven days. 9. That all storage of boxes, crates, and other items be removed from the rear exit. The required exit shall be clear and remain accessible at all times. 10. The property shall be developed per plans, stamped Exhibit B, dated 9-15-92, and approved per Plan check #16831-32, for Conditional Use Permit 87-400 (Rosi's Market). 11. A uniformed security guard licensed by the State of California, Department of Consumer Affairs shall be present on the premises from opening time until one half hour after closing of the last of any liquor licensed businesses in the center. 12. Within ten (10) days after approval of this conditional use permit, the applicant shall submit a notarized affidavit of agreement to the above conditions with the Planning Department.
