PC RESOLUTION 93-15
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ROSEMEAD DENYING
CONDITIONAL USE PERMIT 93-581 FOR
PROPERTY LOCATED AT 8150 E. GARVEY
AVENUE, SUITE 101, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. The Rosemead Planning Commission finds,
determines and declares as follows:
a. An application to establish on-sale beer and wine at an
existing restaurant dba Full-Key BBQ Seafood Restaurant was
duly filed by Bay Siu, Ngh Siu, & Hue Sin; and
b. A public hearing was duly noticed and conducted on March 15,
1993.
Section 2. The Planning Commission finds:
1. That the establishment, maintenance, or operation of the use
so applied for will, under the circumstances of the
particular case, be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons
residing or working in the neighborhood thereof and be
detrimental or injurious to the property and improvements in
the neighborhood or to the general welfare of the City.
2. That the applicant has not sustained the burden of proof
based upon a demonstrated need for the request.
Section 3. Based on the aforementioned findings, the
Commission hereby denies the application for Conditional Use Permit
93-581.
Section 4. This action shall become final and
effective ten (10) days after this decision by the Planning
Commission, unless within such time, a written appeal is filed with
the City Clerk for consideration by the Rosemead City Council, as
provided in the Zoning Code.
Section 5. This resolution is the result of an action
taken by the Planning Commission on March 15, 1993, by the following
vote:
YES: Lowrey, Ruiz, Young, Breen, Ortiz
NO: None
ABSENT: None
ABSTAIN: None
Section 6. The secretary shall certify to the adoption
of this resolution and shall transmit copies of same to the applicant
and the Rosemead City Clerk.
