PC - 1993-13 - Granting Conditional Approval of Tentative tract Map 51544PC RESOLUTION 93-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF TENTATIVE TRACT MAP 51544, ZONE VARIANCE 93-248, ZONE CHANGE 93-193 & GENERAL PLAN AMENDMENT 93-1 FOR PROPERTY LOCATED AT 8445-8463 MISSION DRIVE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Dolly C. Leong, Stanley S. Leong, and Daw H. Shue to subdivide five (5) existing parcels into nine (9) parcels, and obtain Planned Development zone status with a lot area less than the minimum one acre to facilitate development of single-family detached dwellings for property located at: 8445-8463 Mission Drive, or more specifically known as: All of lots 8, 9, 10, 11 & 12 of Tract No. 7666 in the City of Rosemead, County of Los Angeles, State of California, as recorded in book 91, pages 99 and 100 of maps. In the office of the County Recorder of said county; also, that portion of Lot 13 of said tract No. 7666 lying between the northerly prolongation of the westerly line of said Lot 8 and the easterly line of said Lot 9, except the northerly 50 feet thereof; also, that portion of said Lot 13 lying between the northerly prolongation of the westerly line of said Lot 10 and the easterly line of said Lot 12, except the northerly 100 feet thereof, and that a public hearing was duly scheduled for March 1, 1993, at 7:00 p.m.,,in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that this request is in conformance with the Land Use Element of the General Plan, and; 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. 2. The design of the proposed lot consolidation and improvements is consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no significant adverse effects on the environment, and, therefore, a Negative Declaration was prepared and adopted in compliance with Rosemead Resolution 79-77, CEQA, and the guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in the violation of existing requirements as prescribed by the California Regional Water Board. Section 3. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Rosemead does approve the request for the subdivision of this parcel of land described in Section 1, subject to the conditions contained in the attached Exhibit "A". That the property be developed in accordance with Tentative Tract Map 51544 dated 11-10-92, marked Exhibit B and the elevations and floor plans dated 12-3-92, marked Exhibit C, and approved by the Planning Commission on 3-1-93. 2. That the project comply with the conditions as set forth in the City Engineer's report dated 2-10-93, and the Fire Department's recommendations dated 2-4-93. That all conditions shall be completed to the City Engineer's and Director of Planning's satisfaction prior to recordation of the final map. 3. The interior property line of the newly created lots, and where designated by the Director of Planning, the perimeter property line, shall be fenced with a six foot (61) high masonry wall. Said wall shall be installed prior to recordation of the tract map or at the time of issuance of building permit be made a matter of condition. All masonry walls shall be finished on both sides. No required walls shall extend beyond the front yards of each of the dwellings. 4. That each newly created lot along Willard Avenue shall be provided with a 15-gallon tree subject to the approval of the Director of Planning. 5. That all utilities shall be underground including appropriate wiring for Cable Television. The underground conversion of these utilities shall consider all future connections to the satisfaction of the Director of Planning. 6. The existing dwellings shall be boarded until they are demolished. Demolition shall be completed within 90 days of the granting of this tract map. 7. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained to the L.A.County Fire and Health codes until it is developed. While vacant or under construction, it shall be surrounded by a six-foot chain link fence to prohibit traspassing and/or dumping activity. 8. A covenant shall be prepared and approved by the City Attorney assuring that the private, common driveway serving Lots 1-6, inclusive, shall be continually maintained and that any costs associated with such maintenance shall be equally shared by these lots in accordance with Section 9104.21(I)(5)(g). This covenant shall be recorded prior to or in conjunction with the final parcel map. 9. This map shall be finaled and recorded within two (2) years of tentative approval. Failure to do so may result in the map's expiration and the need for another tentative map application. Any request for extension must be submitted, in writing, together with ten (10) copies of the map and corresponding plans, to the Planning Department before the expiration date. 'i.? r"Y 4, . 10. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 11. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 12. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 13. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/411, contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 14. The proposed second floor [on the north side of Lots 3, 4 & 9 shall have windows with lower sills no less than 5.5 feet above the finished floor level to protect the privacy of adjacent residences.
