PC - 1993-11 - Granting Approval of zone Variance 92-249PC RESOLUTION 93-11 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING APPROVAL OF ZONE VARIANCE 92-249 FOR PROPERTY LOCATED AT 4437 DUBONNET, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was filed by Michael & Elisa Douglass to allow the continued use of a room addition constructed without permit which encroaches into the minimum rear yard setback for property located at: 4437 Dubonnet Avenue, and that a public hearing was duly scheduled for February 16, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was duly given; and that a public hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds that facts do exist as required by Section 9171, et seq. of the Rosemead Zoning Code, justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of such variance will not be detrimental to the public health or welfare, or injurious to the property and improvements. 2. That because of special circumstances applicable to the subject property, the strict application of the zoning ordinance would place an undue hardship on the property/project. 3. Based on an environmental study, the proposed project qualifies for a Categorical Exemption under the provisions of CEQA. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants the zone variance with respect to the property described in Section 1, subject to the conditions contained within the attached Exhibit "A". Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time, a written appeal is filed with the City Clerk for consideration by the City Council as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning Commission on February 16, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Young NO: None ABSENT: Breen ABSTAIN: None ADOPTED this 1st day of March, 1993. ; ROBERT K. YOUNG, CHAIRMAN EXHIBIT A ZONE VARIANCE 93-249 4437 DUBONNET AVENUE CONDITIONS OF APPROVAL FEBRUARY 16, 1993 1. The applicant shall sign a notarized affidavit agreeing,to these conditions within ten days of'approval. 2. The property shall be developed in accordance with the plans, dated 12-14-92. Any modification shall require prior Planning Department approval. 3. The property shall comply with all appropriate Building, Fire, and Health Department regulations. 4. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/411, contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 5. The gate separating the front yard from the rear in the northerly side yard shall be repaired to the satisfaction of the Planning and Building Departments.
