PC - 1993-10 - Granting Conditional Use Permit 92-578C 0 PC RESOLUTION 93-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 92-578 TO CONSTRUCT A COMMERCIAL MINI-MALL AT 2547 SAN GABRIEL BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Dung Kim Phu to construct a commercial mini-mall for property located at: 2547 San Gabriel Boulevard, and that a public hearing was duly scheduled for at 7:00 p.m. in the Council Chambers of the Rosem, Valley Boulevard, Rosemead, and that notice of the and purpose of the aforesaid hearings was duly law; and that a public hearing was duly aforementioned time and place. February 16, 1993, aad City Hall, 8838 time, date, place, given according to conducted at the Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seg. of the Ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify, for a Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on February 16, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Young NO : None ABSENT: Breen ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 1st day of March, 1993. A- ROBERT K. YOUNG, CHAIRMAN C EXHIBIT A CONDITIONAL USE PERMIT 93-578 2547 SAN GABRIEL BOULEVARD/8132 FERN AVENUE CONDITIONS OF APPROVAL FEBRUARY 17, 1993 ,1. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. 2. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 3. The property shall be developed in accordance with the plans, dated 1-12-93 (marked Exhibit B). Any modification shall require prior Planning Department approval. 4. The property shall comply with all appropriate Building, Fire, and Health Department regulations. 5. Adequate lighting shall be provided in the parking area. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties. 6. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be,screened from public view when not actually in use. 7. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 8. A 61-high fence, composed of chain link or other approved material, shall totally enclose the perimeter of the property when vacant, under construction, or under demolition, and said fence shall remain until occupancy is granted. 9. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/411, contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 10. Any existing structures to be demolished shall be boarded until such demolition takes place. 11. All utilities shall be underground including appropriate wiring for cable television. The underground conversion of these utilities shall consider all future connections to the satisfaction of the Director of Planning. 12. The applicant shall obtain a Certificate of occupancy permit and any applicable City of Rosemead business license prior to beginning business operations. • 13. The site shall be maintained in a clean, weed and litter-free state in accordance with Sections 5401-5415 of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection and disposal of garbage, rubbish, trash and debris. All trash containers shall be stored in the appropriate trash enclosure. 14. The site shall be maintained in a graffiti-free state. Any graffiti sh all be removed within seventy-two (72) hours. 15. The hours of operation shall be posted in the front window or door. 16. The number of persons inside the unit shall not exceed total building occupancy as determined by the Building Department. 17. Signs shal l comply with Sections 9900-9908 of the Rosemead Municipal Code. Specifically, signs shall not cover more than 15% of wind ow area or 25% of wall areas. 18. A landscaping plan shall be submitted to the Planning Department for review. It shall include an irrigation plan with automatic timers and moisture sensors. Fifteen (15) percent of the landscape area shall be planted with 15-gallon trees. 19. A uniform sign plan shall be submitted for review. Said plan shall include wall signs confined to the facade area immediately above the windows on the facade, and a monument sign. 20. The trash enclosure shall be located in the south-west corner, south of the handicapped parking spot.
