PC - 1993-09 - Granting Conditional Use Permit 92-575• PC RESOLUTION 93-9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 92-575 TO ERECT A 60-FOOT MONOPOLE ANTENNA FOR CELLULAR TELEPHONE SERVICE, LOCATED AT 8629 GARVEY AVENUE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Los Angeles Cellular Telephone Co. to erect a 60-foot monopole antenna for cellular telephone service, for property located at: 8629 Garvey Avenue, and that a public hearing was duly scheduled for January 4, 1993, and continued to February 1, 1993, and February 16, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, and that notice of the time, date, place, and purpose of the aforesaid hearings was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Negative Declaration under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on February 16, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Young NO : None ABSENT: Breen ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 1st day of March, 1993. ROBERT K. YOUNG, CHAIRMAN EXHIBIT A CONDITIONAL USE PERMIT 92-575 LA CELLULAR 8629 GARVEY AVENUE #5/6 CONDITIONS OF APPROVAL FEBRUARY 17, 1993 1. This conditional use permit approval shall expire after one (1) year that there is no progress towards completion of the authorized use. 2. The following conditions must be complied with to the satisfaction of the Director of Planning, prior to final approval of associated maps, building permits, occupancy permits, or any other appropriate request. 3. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. i • 4. The conditions listed onto development plans Departments for review. 5. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall'be directed away from adjacent properties. 8. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the County Fire and Health codes until it is developed. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. Trash bins shall be located within the enclosures or the fenced area west of 8623 Garvey Avenue #D. 9. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 10. A 61-high fence, composed of chain link or other approved material, shall totally enclose the perimeter of the area, under construction, and said fence shall remain until occupancy is granted. 11. All utilities and connection cables shall be underground. The underground conversion of these utilities shall consider all future connections to the satisfaction of the Director of Planning. 12. A minimum of two new trees shall be provided in the vicinity of the monopole platform, including those existing as indicated on Exhibit C. The size and location of new trees shall be at the discretion of the Planning Department and all existing trees maintained. 13. The applicant shall obtain a Certificate of Occupancy permit for the equipment room prior to beginning operations. 14. The site shall be maintained in a graffiti-free state. Any new graffiti shall be removed within twenty-four (24) hours. 15. The parking space markers shall be re-painted periodically to City standards to the satisfaction of the Planning Department, including double-striping and wheel stops. 16. Six-foot high masonry walls with finished surface on both sides, shall be provided along the entire north property line and the northern end of the east property line. Said walls shall be constructed before building permit issuance (beginning of construction). 17. The monopole shall be painted sky blue. 18. No auto repair, sewing factory, and business operations in any of the property's units shall be allowed outside the building. Specifically, the fenced area to the west of 8623 Garvey Avenue #D shall not be used by the factory. 19. No inoperable vehicle storage, nor auto parts storage shall be allowed in the parking area. 20. No auto parts storage shall be allowed in the fenced area in the northeast corner of the property. 21. A covenant to tie the two parcels together shall be signed by the owner and recorded prior to occupancy approval. 22. All applicable Federal and State licenses shall be obtained and maintained in good standing prior to construction.
