PC - 1993-08 - Granting Conditional Use Permit 92-572PC RESOLUTION 93-8 0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 92-572 AND ZONE VARIANCE 92-245 TO ESTABLISH A RESTAURANT/NIGHTCLUB, LOCATED AT 2111 SAN GABRIEL BOULEVARD, SUITES J, K, L, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Lawrence Lee to establish a restaurant/nightclub dba Manna Restaurant, with a shortage of parking spaces, for property located at: 2111 N. San Gabriel Boulevard, Suites J, K, L, and that a public hearing was duly scheduled for February 1, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, and 9170 et seq. of the Ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit and Zone Variance. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The, project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Negative Declaration under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit and Zone Variance with respect to the property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on February. 1, 1993, by the following vote: YES: Ruiz, Lowrey, Breen, Young NO : None ABSENT: Ortiz ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 16th day of February, 1993. MERCED "BILL" ORTIZ, CHAIRMAN CONDITIONAL USE PERMIT 92-572 ZONE VARIANCE 92-245 2111 N. SAN GABRIEL BOULEVARD, SUITES J, K & L MANNA RESTAURANT CONDITIONS OF APPROVAL FEBRUARY 2, 1993 1. This conditional use permit is approved for six (6) months, at which time it shall be reviewed by the Planning commission for an extension. The occupant shall file a request for extension at least 30 days before expiration with the Planning Department. This approval shall expire after one (1) year without progress towards completion of the use authorized by this conditional use permit. 2. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. 3. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 4. The property shall comply with all appropriate Building, Fire, and Health Department regulations. 5. The applicant shall obtain a Certificate of occupancy permit and any applicable City of Rosemead business license prior to beginning business operations. 6. The site shall be maintained in a clean, weed and litter-free state in accordance with Sections 5401-5415 of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection and disposal of garbage, rubbish, trash and debris. All trash containers shall be stored in the appropriate trash enclosure. 7. The site shall be maintained in a graffiti-free state. Any graffiti shall be removed within seventy-two (72) hours. 8. The hours of operation shall be posted in the front window or door. Hours of operation shall be limited from 9 p.m. to 2 a.m Monday to Friday, and 9:30 p.m. to 2 a.m. Saturday and Sunday. 9. The number of persons inside the unit shall not exceed total building occupancy as determined by the Building Department. 10. Signs shall comply with Sections 9900-9908 of the Rosemead Municipal Code. Specifically,. signs shall not cover more than 158 of window area or 258 of wall areas. 11. The closing time for the existing restaurant shall be commensurate with the opening time of the proposed addition (9:00 pm on week days and 9:30 p.m. on weekends). There shall be no patrons lingering 30 minutes after closing time.
