PC - 1993-05 - Granting Approval of Zone Variance 92-247PC RESOLUTION 93-5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING APPROVAL OF ZONE VARIANCE 92-247 FOR PROPERTY LOCATED AT 9540 VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was filed by Sunshine Car Wash to continue to perform auto maintenance in a building not fully enclosed and not providing the minimum setback, for property located at: 9540 Valley Boulevard, and that a public hearing at 7:00 p.m. in the Council Valley Boulevard, Rosemead, date, place and purpose of that a public hearing was place. was duly scheduled for January 18, 1993, Chambers of the Rosemead City Hall, 8838 California; and that notice of the time, the aforesaid hearing was duly given; and duly held at the aforementioned time and Section 2. The Planning Commission further finds that facts do exist as required by section 9171, et seq. of the Rosemead Zoning Code, justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of such variance will not be detrimental to the public health or welfare, or injurious to the property and improvements. 2. That because of special circumstances applicable to the subject property, the strict application of the zoning ,ordinance would place an undue hardship on the property/project. 3. Based on an environmental study, the proposed project qualifies for a Categorical Exemption under the provisions of CEQA. Section 4. Based on the aforementioned findings, the Planning commission hereby grants the zone variance with respect to the property described in section 1, subject to the conditions contained within the attached Exhibit "A". Section 5. This action shall become final and effective ten (10) days after this decision by the Planning commission unless within such time, a written appeal is filed with the City Clerk for consideration by the City Council as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning commission on January 18, 1993, by the following vote: YES: Lowrey, Ruiz, Ortiz, Breen, Young NO: None ABSENT: None ABSTAIN: None ADOPTED this 1st day of February, 1993. Q o~ i MERCED "BILL" ORTIZ, CHAIRMAN EXHIBIT A ZONE VARIANCE 92-247 9540 VALLEY BOULEVARD - SUNSHINE CAR WASH CONDITIONS OF APPROVAL JANUARY 21, 1993 1. This zone variance approval shall expire after one (1) year that there is no progress towards completion of the authorized use. 2. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. 3. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 4. The property shall be developed in accordance with the plans, dated 12-2-92 (marked Exhibit B). 5. The site shall be maintained in a clean, weed and litter-free state in accordance with Sections 5401-5415 of the Rosemead Municipal Code, which pertains to the storage, accumulation, collection and disposal of garbage, rubbish, trash and debris. All trash containers shall be stored in the appropriate trash enclosure. The entire area, including the residential home, shall be maintained clear of any hazardous materials. 6. The site shall be maintained in a graffiti-free state. All graffiti shall be removed within 72 hours. 7. The parking space markers shall be re-painted periodically to City standards to the satisfaction of the Planning Department, including double-striping and wheel stops. 8. The project shall be provided with one trash enclosure space, per Section 9121.30. 9. All planting areas shall be regularly maintained and installed with permanent irrigation systems. 10. Existing signs shall be brought into conformance with the provisions of Section 9184G of the Municipal Code. 11. The applicant shall obtain a Certificate of occupancy for the subject maintenance building. 12. The hours for the steam cleaning operation shall be limited to - regular business hours, 8 am to 5 pm, Monday through Friday. 13: No mechanical work shall be allowed in the area designated for steam cleaning. 14. No external music shall be allowed. 15. The planter area shall be maintained with new plants; the existing trees shall be removed, and the existing wall shall be repaired and sealed 18 inches below the surface. 16. Notices shall be posted on the wall stating that dumping of oil is illegal. 17. Motion-activated ' lights shall be installed where deemed appropriate. by the Director of Planning.
