PC - 1993-03 - Granting Conditional Use Permit 92-5730 r PC RESOLUTION 93-3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 92-573 ALLOWING THE ADDITION OF A LIBRARY TO AN EXISTING BUDDHIST TEMPLE LOCATED AT 7833 EMERSON PLACE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Godakalanda Gunaratana for the addition of a library and expansion of existing living quarters at an existing Buddhist temple located at: 7833 Emerson Place, and that a public hearing was duly scheduled for December 7, 1992 and continued to January 4, 1993, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given according to law; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section,9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit with respect to the property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on January 4, 1993, by the following vote: YES: -Lowrey, Ruiz, Ortiz, Breen, Young NO : None ABSENT: None ABSTAIN: None Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 18th day of January, 1993. MERCED "BILL" ORTI , CHAIRMAN EXHIBIT A CONDITIONAL USE PERMIT 92-573 ROSEMEAD BUDDHIST LIBRARY 7839 EMERSON PLACE CONDITIONS OF APPROVAL JANUARY 4, 1993 1. The following conditions must be complied with to the satisfaction of the Director of Planning, prior to final approval of associated maps, building permits, occupancy permits, or any other appropriate request. 2. The applicant shall sign a notarized affidavit agreeing to these conditions within ten days of approval. 3. The conditions listed on this Exhibit shall be copied directly onto development plans submitted to the Planning and Building Departments for review. 4. The property shall be developed in accordance with the plans dated 10-19-92 (marked Exhibit B), except where otherwise noted. Any modification shall require prior Planning Department approval. 5. The property shall comply with all appropriate Building, Fire, and Health Department regulations. 6. Adequate lighting shall be provided ,in the parking area. Motion-activated lights shall be installed . where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties. 7. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 8. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 9. A 61-high fence, composed of chain link or other approved material, shall totally enclose the perimeter of the property when vacant, under construction, or under demolition, and said fence shall remain until Occupancy is granted. 10. The westerly perimeter property line of 7833 Emerson Place shall be fenced with a six-foot (61) high masonry wall, with finished surface on both sides. This wall may end at the rear property boundary intersection. .11. All utilities shall be underground including appropriate wiring for cable television. The underground conversion of these utilities shall. consider all future connections to the satisfaction of the Director of Planning. 12. A detailed landscaping/irrigation plan shall be submitted together with development plans. 13. The applicant shall obtain a Certificate of Occupancy permit prior,to beginning operations. 14. A tentative map to consolidate parcels 23 and 24 shall be filed within six (6) months of this permit approval and such map shall be recorded before building occupancy is granted.
