A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE
PERMIT 94-618 ALLOWING THE OPERATION OF A
SEWING FACTORY AT 8815 E. GARVEY AVENUE,
ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission of the City of
Rosemead does hereby find and determine that an application was duly
filed by Hoi Loong Hy to establish the operation of a sewing factory,
dba Hy Ly Fashion, located at:
8815 E. Garvey Avenue,
and that a public hearing was duly scheduled for November 21, 1994,
at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838
Valley Boulevard, Rosemead, and that notice of the time, date, place,
and purpose of the aforesaid hearing was duly given according to law;
and that a public hearing was duly conducted at the aforementioned
time and place.
Section 2. The Planning Commission further finds and
determines that facts do exist as required by Section 9181, et seq.
of the ordinance of the City of Rosemead justifying the granting of a
Conditional Use Permit.
Section 3. The Planning Commission further finds:
1. The project is in harmony with the elements and objectives
of the General Plan.
2. The project will not be detrimental to the surrounding
properties.
3. The project is desirable to the public convenience.
Section 4. On the basis of evaluation, this project
has been determined to qualify for a Class 9 Categorical Exemption
under the provisions of the California Environmental Quality Act.
Section 5. Based on the above findings, the Planning
commission hereby grants a Conditional Use Permit for property
described in Section 1, subject to the conditions contained within
the attached Exhibit A.
Section 6. This action shall become final and
effective ten (lo) days after this decision by the Planning
Commission, unless within such time a written appeal is filed with
the City Clerk for consideration by the Rosemead City Council as
provided in the Zoning Ordinance.
Section 7. This resolution is the result of an action
taken by the Planning Commission on November 21, 1994, by the
following vote:
YES: Loi, Ruiz, Lowrey, Breen, Ortiz
NO : None
ABSENT: None
ABSTAIN: None
Section 8. The secretary shall certify to the adoption
of this Resolution and shall transmit copies of same to the applicant
and Rosemead City Clerk.

CONDITIONAL USE PERMIT 94-618
HY LY FASHION, INC. - 8815 E. GARVEY AVENUE
CONDITIONS OF APPROVAL
NOVEMBER 21, 1994
1. This project shall be developed as per the site and floor plan,
marked Exhibit B.
2. This conditional use permit shall be issued for six (6) months
and may be extended, upon request of the applicant, by the
Planning commission without benefit of a public hearing. The
applicant shall file a request to extend the conditional use
permit within thirty (30) days prior to its expiration.
3. The project shall comply with all Building & Fire Department
requirements.
4. The business shall operate with no more than ten (10) persons at
any time.
5. The occupant shall comply with Section 5401-5415 of the Rosemead
Municipal Code, which pertains to the storage, accumulation,
collection and disposal of garbage, rubbish, trash and debris.
6. The applicant shall sign an affidavit of agreement, and return it
to the Planning Department within ten (10) days after approval of
this request.
7. The applicant shall abide by the Health and Safety regulations of
other jurisdictions.
8. The site shall be maintained in a graffiti-free state. Any new
graffiti shall be removed within twenty-four (24) hours.
9. The parking space markers shall be re-painted to City standards
to the satisfaction of the Planning Department, including
double-striping and wheel stops.
10. A copy of the "Garment Manufacturing License" from the State of
California Department of Industrial Relations shall be submitted.
11. All work related to the garment manufacturing business shall be
performed inside the building.
12. The building shall not be used as a residence. In addition, a
covenant shall be filed with the Planning Department prohibiting
the building to be used as such.
