AS FOLLOWS:
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ROSEMEAD DENYING
TENTATIVE PARCEL MAP 24045 AND ZONE
VARIANCE 94-266 FOR PROPERTY LOCATED AT
9318 RALPH STREET, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RESOLVES
Section 1. The Planning Commission of the City of
Rosemead does hereby find and determine that an application was duly
filed by Mike Yoakum and Kent Wu to subdivide an existing lot into two
parcels and a zone variance for a 45 foot wide lot in lieu of the
required 50 feet and a minor reduction of the side yard requirement
for the existing dwelling for property located at:
9318 Ralph Street,
and that according to law a public hearing was duly noticed and
scheduled for October 17, 1994, at 7:00 p.m. in the Council Chambers
of the City of Rosemead, 8838 E. Valley Boulevard, Rosemead,
California; and that notice of the time, date, place,and purpose of
the aforesaid hearings was duly given according to law; and that a
public hearing was duly conducted at the aforementioned time and
place.
Section 2. After conducting the public hearing and
consideration of the request, the Planning commission finds and
determines that facts have not been established by the applicant to
justify the granting of the request indicated in Section 1.
1. That such variance will be materially detrimental to the
public health and welfare and injurious to the property or
improvements in the vicinity in which the property is
located.
2. That the applicant failed to show any special circumstances
applicable to subject property, including size, shape,
topography, location or surroundings that would justify
variance from the strict application of the zoning ordinance.
3. The subject property is not deprived of privileges enjoyed by
other properties in the vicinity and under identical zone
classification.
