PC - 1994-20 - Denying Conditional Use Permit 94-617PC RESOLUTION 94-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING CONDITIONAL USE PERMIT 94-617 FOR PROPERTY LOCATED AT 9200 VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Rosemead Planning Commission finds, determines and declares as follows: a. That an application was duly filed by Intertrust Development to add nine (9) parking spaces to an existing shopping center at: 9200 E. Valley Boulevard b. That a public hearing was duly noticed and conducted on September 6, 1994, at 7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard, Rosemead, and that 'notice of the time, date, place and purpose of the aforesaid hering was duly given according to law, and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission finds: 1. That the establishment, maintenance, or operation of the use so applied for will, under the circumstances of the particular case, be detrimental to the health, safety, peace, morals, or comfort or general welfare of persons residing or working in the neighborhood thereof and be detrimental or injurious to the property and improvements in the neighborhood or to the general welfare of the City. 2. That the applicant has not sustained the burden of proof based upon a demonstrated need for the request. 3. That the establishment will be detrimental or injurious to the property and improvements in the neighborhood or to the general welfare of the City. 4. That the applicant has not sustained the burden of proof that nearby residential zones will not be detrimentally affected. Section 3. Based on the aforementioned findings, the Commission. hereby denies the application for Conditional Use Permit 94-617. Section 4. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time, a written appeal is filed with the City Clerk for consideration by the Rosemead City council, as provided for within the Zoning Code. Section 5. This resolution is the result of an action taken by the Planning commission on September 6, 1994, by the following vote: YES: Loi, Ruiz, Lowrey, Breen NO: None ABSENT: Ortiz ABSTAIN None ti t PC Resolution 94-20 page 2.
