PC - 1994-19 - Granting Conditional Approval of Design Review 94-63PC RESOLUTION 94-19
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF
DESIGN REVIEW 94-63 AND ZONE VARIANCE 94-267 FOR
PROPERTY LOCATED AT 9049 E. VALLEY BOULEVARD,
ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find
and determine that an application was duly filed by Wendy Shen to
provide nine (9) parking spaces in lieu of the required eleven (11)
spaces and to remodel the front facade of an existing building in a
design overlay zone located at:
9049 E. Valley Boulevard
and that a public hearing was duly scheduled for September 6, 1994,
at 7:00 p.m. in the Council Chambers of Rosemead City Hall, 8838
Valley Boulevard, Rosemead, California; and that notice of the time,
date, place, and purpose of the aforesaid hearing was duly given; and
that a public hearing was duly conducted at the aforementioned time
and place.
Section 2. The Planning Commission further finds and
determines that facts do exist as required by Section 9119 and 9171
et seq. of the Ordinance of the City of Rosemead, justifying the
granting of approval of the design review application.
Section 3. The Planning commission further finds:
1. The plans indicate proper consideration for the
relationship between the proposed building and site
developments that exist or have been approved for the
general neighborhood;
2. The proposed site development is not, in its exterior
design and appearance, so at variance with the
appearance of other existing buildings or site
developments in the neighborhood as to cause the nature
of the local environment to materially depreciate in
appearance and value;
3. That the granting of such variance will not be
detrimental to the public health or welfare, or
injurious to the property and improvements.
4. That because of special circumstances applicable to the
subject property, the strict applicaiton of the zoning
ordinance would place an undue hardship on the
property/project.
5. On the basis of evaluation, this project has been
determined to qualify for a Negative Declaration in
accordance with CEQA and local regulations.
Section 4. Based on the aforementioned findings, the
commission hereby approves the design review and zone variance
applications with respect to the property described in Section 1 of
this resolution, subject to the conditions contained within the
attached Exhibit A.
Section 5. This action shall become final and
effective ten (10) days after this decision by the Planning
Commission unless within such time a written appeal is filed with the
City Clerk for consideration by the Rosemead City Council.
