A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING APPROVAL OF
ZONE VARIANCE 94-265 TO MAINTAIN A SIGN WITH
ELECTRONIC READER BOARD LOCATED AT 500
MONTEBELLO BOULEVARD, ROSEMEAD.
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find
and determine that an application was filed by North American TV, for
a variance to maintain a 75 foot high pole sign with a 355 square
foot double-faced identification sign and 355 square electronic
reader board at:
500 Montebello Boulevard,
and that a public hearing was duly scheduled for August 15, 1994, at
7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838
Valley Boulevard, Rosemead, California; and that notice of the time,
date, place and purpose of the aforesaid hearing was duly given; and
that a public hearing was duly held at the aforementioned time and
place.
Section 2. The Planning Commission further finds that
facts do exist as required by Section 9171, et seq. of the Rosemead
Zoning Code, justifying the granting of a zone variance.
Section 3. The Planning Commission further finds:
1. That the granting of such variance will not be
detrimental to the public health or welfare, or
injurious to the property and improvements.
2. That because of special circumstances applicable to the
subject property, the strict application of the zoning
ordinance would place an undue hardship on the
property/project.
3. Based on an environmental study, the proposed project
qualifies for a Class 1 Categorical Exemption under the
provisions of CEQA.
Section 4. Based on the aforementioned findings, the
Planning commission hereby grants the zone variance with respect to
the property described in Section 1, subject to the conditions
contained within the attached Exhibit "A".
Section 5. This action shall become final and
effective ten (10) days after this decision by the Planning
commission unless within such time, a written appeal is filed with
the City Clerk for consideration by the City Council as provided in
the Zoning Ordinance.
Section 6. This resolution is the result of an action
taken by the Planning Commission on August 15, 1994, by the following
vote:

500 MONTEBELLO BOULEVARD
CONDITIONS OF APPROVAL
AUGUST 15, 1994
1. The project shall comply with the plans marked Exhibit "B" and
approved by the Planning Commission on August 15, 1994.
2. The property shall comply with all Building and Fire Department
regulations.
3. The property shall be kept cleared of weeds, debris and abandoned
vehicles, and maintained pursuant to the L.A. County Fire and
Health codes until it is developed. All trash shall be contained
in dumpsters and removed on an as-needed basis. No trash shall be
visible from outside the dumpster. Surplus construction materials
shall be stored so as to be screened from public view when not
actually in use.
4. Construction activities shall be limited to take place between
the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No
construction shall take place on Sundays or on any legal
holidays.
5. This approval shall expire after one (1) year if there is no
progress towards completion of the use authorized by the
variance.
6. The conditions listed on this Exhibit shall be incorporated
verbatim on development plans submitted to the Planning and
Building Departments for review.
7. The applicant shall sign an affidavit of agreement, and return it
to the Planning Department within ten (10) days after approval of
this request.
8. That the information advertised on the readerboard shall be
limited to North American Television (NATV) and related services
provided. No off-site advertisement of products or services not
directly related to NATV shall be permitted at any time.
9. That the messages advertized on the readerboard shall comply with
the regulations set forth with the California Department of
Transportation (Caltrans).
10. That the compact spaces be limited to 25% of the total number of
parking spaces on the property and the entire parking area be
re-striped in thirty (30) days.
11. That any satellite dish antennas mounted above the roof shall be
screened from public view subject to review and approval of the
Director of Planning.
12. That the rear portion of the building formally used as vehicle
service bays shall be utilized as warehouse/storage. Any future
uses which are classified as assembly or auditorium uses based on
zoning and occupancy standards shall require a conditional use
permit approved by the Planning Commission pursuant to Sections
9122.7 and 9181 of the Rosemead Municipal Code.
