PC - 1994-17 - Granting Conditional Approval of Design Review 94-62PC RESOLUTION 94-17 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF DESIGN REVIEW 94-62 APPROVING THE RENOVATION OF AN EXISTING OFFICE AND RESTAURANT, AND FRONT FACADE IMPROVEMENTS FOR PROPERTY LOCATED AT 9139-43 E. VALLEY BOULEVARD, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Wendy Shen to remodel the existing office and restaurant, and front facade improvements for property in Central Business District (CBD) Design overlay zone located at: 9139-43 E. Valley Boulevard and that a public hearing was duly scheduled for August 15, 1994 at 7:00 p.m. in the Council. Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place, and purpose of the aforesaid hearing was duly given; and that a public hearing was duly conducted at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9119 et seq. of the ordinance of the City of Rosemead, justifying the granting of approval of the design review application. Section 3. The Planning Commission further finds: 1. The plans indicate proper consideration for the relationship between the proposed remodel and site developments that exist or have been approved for the general neighborhood; 2. The proposed site development is not, in its exterior design and appearance, so at variance with the appearance of other existing buildings or site developments in the neighborhood as to cause the nature of the local environment to materially depreciate in appearance and value; 3. On the basis of evaluation, this project has been determined to qualify for a Categorical Exemption in accordance with CEQA and local regulations. Section 4. Based on the aforementioned findings, the Commission hereby approves the design review application with respect to the property described in Section 1 of this resolution, subject to the conditions contained within the attached Exhibit A. Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council. Section 6. This resolution is the result of an action taken by the Planning Commission on August 15, 1994, by the following vote: YES: Loi, Ruiz, Lowrey, Breen, Ortiz NO: None ABSENT: None ABSTAIN: None ADOPTED this 6th day of September, 1994. VALLEY BOULEVARD CONDITIONS OF APPROVAL AUGUST 15, 1994 1. This approval shall expire after one (1) year if there is no progress towards completion submitted to the Planning Department. 2. The project shall be developed as shown on the plans and marked as Exhibit B. 3.. All exterior lighting shall be directed away from adjacent properties. 4. All paving shall be 4" of AC over 6" base, or 6" of concrete. 5. That the property shall be cleared of weeds, debris, abandoned structures and vehicles, and secured with adequate fencing until the property is developed according to approved plans. 6. The parking space markers shall be re-painted periodically to City standards to the satisfaction of the Planning Department, including double-striping and wheel stops. 7. The property shall comply with all appropriate Building, Fire, and Health Department regulations. 8. The property shall be developed in accordance with the plans, marked Exhibit "B" except otherwise noted. Any modification shall require prior Planning Department approval. 9. Signs shall comply with Sections 9900-9908 of the Rosemead Municipal Code. Specifically, signs shall not cover more than 15% of window area or 25 % of wall areas. 10. A landscaping planter to serve as a buffer for light,and glare shall be maintained along the eastern property line to the satisfaction of the Planning Director. 11. The trash enclosure shall be remodeled and relocated towards the driveway of the restaurant and the frequency of trash pick-up shall be increased to the satisfaction of the Planning Director. 12. An affidavit of agreement to these conditions shall be signed within ten (10) days of the time the design is granted. VDR62
