HELLMAN THE PLANNING HEREBY RESOLVE AS FOLLOWS: OF THE PLANNING COMMISSION OF ROSEMEAD GRANTING APPROVAL OF 94-264 FOR PROPERTY LOCATED AT AVENUE, ROSEMEAD. COMMISSION OF THE CITY OF ROSEMEAD DOES Section 1. The Planning Commission does hereby find and determine that an application was filed by Gregg Asuncion to construct a 416 square foot one story room addition to an existing single family dwelling with a one (1) car garage in lieu of the required two (2) car garage located at: 7630 E. Hellman Avenue, and that a public hearing 7:00 p.m. in the Council Valley Boulevard, Rosemead, date, place and purpose of that a public hearing was place. was duly scheduled for April 4, 1994, at Chambers of the Rosemead City Hall, 8838 California; and that notice of the time, he aforesaid hearing was duly given; and duly held at the aforementioned time and Section 2. The Planning Commission further finds that facts do exist as required by Section 9171, et seq. of the Rosemead Zoning Code, justifying the granting of a zone variance. Section 3. The Planning Commission further finds: 1. That the granting of such variance will not be detrimental to the public health or welfare, or injurious to the property and improvements. 2. That because of special circumstances applicable to the subject property, the strict application of the zoning ordinance would place an undue hardship on the property/project. 3. Based on an environmental study, the proposed project qualifies for a Categorical Exemption under the provisions of CEQA. Section 4. Based on the aforementioned findings, the Planning Commission hereby grants the zone variance with respect to the property described in Section 1, subject to the conditions contained within the attached Exhibit "A". Section 5. This action shall become final and effective ten (10) days after this decision by the Planning Commission unless within such time, a written appeal is filed with the City Clerk for consideration by the City Council as provided in the Zoning Ordinance. Section 6. This resolution is the result of an action taken by the Planning Commission on April 4, 1994, by the following vote: YES: Lowrey, Ruiz, Young, Breen, Ortiz NO: None ABSENT: None ABSTAIN: None ADOPTED this 18th day of April, 1994. HELLMAN AVENUE CONDITIONS OF APPROVAL APRIL 4, 1994 1. The project shall comply with the plans dated January 19, 1994 and approved by the Planning Commission on April 4, 1994. 2. The property shall comply with all Building and Fire Department regulations. 3. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the L.A. County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 4. All building and/or zoning violations shall be corrected. 5. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 6. A 61-high chain link, or other approved material, fence shall totally enclose the perimeter of the property when vacant, under construction, or under demolition, and said fence shall remain until Occupancy is granted. 7. This approval shall expire after one (1) year that there is no progress towards completion of the use authorized by the variance. 8. The conditions listed on this Exhibit shall be incorporated verbatim on development plans submitted to the Planning and Building Departments for review. 9. The applicant shall sign an affidavit of agreement, and return it to the Planning Department within ten (10) days after approval of this request. 10. The garage conversion must return to a garage prior to issuance of building permit. 11. A covenant holding the subject property to a single family dwelling with a one-car garage shall be recorded on the property. UZV264 !
