THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission of the City of
Rosemead does hereby find and determine that an application was duly
filed by Martin Lin to consolidate four (4) lots into one (1) and to
expand an existing church in the C-3 and P zones located at:
3027 Del Mar Avenue,
and that a public hearing was duly scheduled for March 21, 1994, at
7:00 p.m. in the Council Chambers of the Rosemead City Hall, 8838
Valley Boulevard, Rosemead,.and that notice of the time, date, place
and purpose of the aforesaid hearings was duly given according to
law; and that a public hearing was duly conducted at the
aforementioned time and place.
Section 2. The Planning Commission finds and
determines that facts do exist as required by Section 9181, et seq.
of the Ordinance of the City of Rosemead justifying the granting of a
Conditional Use Permit;
1. The project is in harmony with the elements and objectives
of the General Plan.
2. The project will not be detrimental to the surrounding
properties.
3. The project is desirable to the public convenience.
4. That the establishment, maintenance, or conduct of the use
for which the conditional use permit is sought will not,
under the particular case, be detrimental to the health,
safety, morals, comfort, convenience, or welfare of persons
residing or working in the neighborhood of such use and will
not, under the circumstances of the particular case, be
detrimental to the public welfare or injurious to the
property or improvements in the neighborhood.
Section 3. The Planning Commission further finds and
determines that facts do exist in justifying the granting of a
Tentative Parcel Map based on the following findings:
1.
The
proposed subdivision, together with the provisions for
its
design
and improvements, are consistent with the General
Plan
or any
applicable specific plan.
2.
The
site is
physically suitable for the type of development.
3.
The
site is
suited for the proposed density of development.
4.
The
design
of the subdivision will not conflict with public
ease
ments.
5. The discharge of wastes from the proposed subdivision will
not result in the violation of existing requirements as
prescribed by the California Regional Water Board.
Section 4. Based upon an initial study, the Planning
Commission has determined that the design and proposed improvements
of the subdivision and conditional use permit will have no
significant adverse effects on the environment, and, therefore, a

taken by the Planning commission on March 21, 1994, by the following

Section 8. The secretary shall certify to the adoption
of this Resolution and shall transmit copies of same to the applicant

CONDITIONS OF APPROVAL
MARCH 21, 1994
1. The following conditions must be complied with to the
satisfaction of the Director of Planning, prior to final approval
of associated maps, building permits, occupancy permits, or any
other appropriate request.
2. The applicant shall sign a notarized affidavit agreeing to these
conditions within ten days of approval.
3. The conditions listed on this Exhibit shall be copied directly on
the development plans submitted to the Planning and Building
Departments for review.
4. The property shall be developed in accordance with the site plans
marked Exhibit B, except where otherwise noted. Any modification
shall require prior Planning Department approval.
5. The property shall comply with all appropriate Building, Fire,
and Health Department regulations.
6. Adequate lighting shall be provided in the parking area.
Motion-activated lights shall be installed where deemed
appropriate by the Director of Planning. All exterior lighting
shall be directed away from adjacent properties.
7. The property shall be kept cleared of weeds, debris and abandoned
vehicles, and maintained pursuant to the County Fire and Health
codes until it is developed. All trash shall be contained in
dumpsters and removed on an as-needed basis. No trash shall be
visible from outside the dumpster. Surplus construction
materials shall be stored so as to be screened from public view
when not actually in use.
8. Construction activities shall be limited to take place between
the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No
construction shall take place on Sundays or on any legal
holidays.
9. A 61-high fence, composed of chain link or other approved
material, shall totally enclose the perimeter of the property
when vacant, under construction, or under demolition, and said
fence shall remain until Occupancy is granted.
10. All parking lot areas shall be fenced with a six-foot (61) high
masonry wall, with finished surface on both sides, to the
discretion of the Planning Director.
` 11. All utilities shall be underground including appropriate wiring
for cable television. The underground conversion of these
utilities shall consider all future connections to the
satisfaction of the Director of Planning.
12. A detailed landscaping/irrigation plan shall be submitted
together with development plans.
13. The applicant shall obtain a

Certificate of occupancy permit
14. The property shall be developed in accordance with Parcel Map
23797 marked Exhibit "C", and approved by the Planning Commission
on March 21, 1994.
15. The project shall comply with the conditions as set forth in the
City Engineer's report dated 3-2-94, and the L.A. County Fire
Department's requirements. All conditions shall be completed to
the City Engineer's and Director of Planning's satisfaction prior
to recordation of the final map.
16. This map shall be finaled and recorded within two (2) years of
tentative approval. Failure to do so may result in the map's
expiration and the need for another tentative map application.
Any request for extension must be submitted, in writing, together
with ten (10) copies of the map and corresponding plans, to the
Planning Department before the expiration date.
17. The numbers of the address signs shall be at least 6" tall with a
minimum character width of 1/411, contrasting in color and easily
visible at driver's level from the street. The location, color
and size of such sign shall be subject to the approval of the
Planning Director.
18. Eliminate the existing property line shown on the tentative
parcel map which currently divides the lot into two lots and
designate the proposed lot as "Lot 1."
19. Front setback shall not exceed setback of existing Temple.
20. Based on the plans submitted, the occupancy load shall not exceed
210 persons based on the Uniform Building Code. The occupancy
load may be revised, provided, a revised set of plans are
submitted subject to the approval of the Director of Planning and
Building Official.
