PC RESOLUTION 94-03 OF THE PLANNING COMMISSION OF DSEMEAD GRANTING CONDITIONAL USE TO ALLOW CONSTRUCTION OF A FEET SINGLE FAMILY DWELLING IN LOCATED AT 7616 FERN AVENUE, THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Kwok Tien Wu to construct a 3,477 square feet single family dwelling in an R-2 zone located at: 7616 Fern Avenue, and that a public hearing was duly scheduled 7:00 p.m. in the Council Chambers of the Valley Boulevard, Rosemead, and that notice and purpose of the aforesaid hearings wa law; and that a public hearing was aforementioned time and place. for January 17, 1994, at Rosemead City Hall, 8838 of the time, date, place s duly given according to duly conducted at the Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning.Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on January 17, 1994 , by the following vote: YES: Lowrey, Ruiz, Young Breen NO: None ABSENT: Ortiz ABSTAIN: None Section 8. This approval shall expire after one (1) year that there is no progress towards completion of the use authorized by the conditional use permit. 2. The following conditions must be complied with to the satisfaction of the Director of Planning prior to final approval of building permits or any other request. 3. The property shall comply with all Building and Fire Department regulations. 4. The conditions listed on this Exhibit shall be incorporated verbatim on development plans submitted to the Planning and Building Departments for review. 5. The property shall be developed in accordance with the plans, (marked Exhibit B), except where otherwise noted. 6. The property shall be kept cleared of weeds, debris and abandoned vehicles, and maintained pursuant to the L.A. County Fire and Health codes until it is developed. All trash shall be contained in dumpsters and removed on an as-needed basis. No trash shall be visible from outside the dumpster. Surplus construction materials shall be stored so as to be screened from public view when not actually in use. 7. All building and/or zoning violations shall be corrected. 8. Construction activities shall be limited to take place between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday. No construction shall take place on Sundays or on any legal holidays. 9. A 61-high chain link, or other approved material, fence shall totally enclose the perimeter of the property when vacant, under construction, or under demolition, and said fence shall remain until occupancy is granted. 10. The numbers of the address signs shall be at least 6" tall with a minimum character width of 1/411, contrasting in color and easily visible at driver's level from the street. The location, color and size of such sign shall be subject to the approval of the Planning Director. 11.
