PC - 1994-02 - Granting Conditional Use Permit 93-604PC RESOLUTION 94-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 93-604 ALLOWING THE TRANSFER OF AN ABC LICENSE FOR THE SALE OF LIQUOR AT 8606 E. GARVEY AVENUE, ROSEMEAD. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission of the City of Rosemead does hereby find and determine that an application was duly filed by Peter Hieng for the transfer of an ABC license for the sale of liquor at G. W. Liquor located at: 8606 E. Garvey Avenue and that a public hearing at 7:00 p.m. in the Council Valley Boulevard, Rosemead, and purpose of the aforesaid and that a public hearing time and place. was duly scheduled for January 17, 1994, Chambers of the Rosemead City Hall, 8838 and that notice of the time, date, place, hearing was duly given according to law; was duly conducted at the aforementioned Section 2. The Planning Commission further finds and determines that facts do exist as required by Section 9181, et seq. of the ordinance of the City of Rosemead justifying the granting of a Conditional Use Permit. Section 3. The Planning Commission further finds: 1. The project is in harmony with the elements and objectives of the General Plan. 2. The project will not be detrimental to the surrounding properties. 3. The project is desirable to the public convenience. Section 4. On the basis of evaluation, this project has been determined to qualify for a Categorical Exemption under the provisions of the California Environmental Quality Act. Section 5. Based on the above findings, the Planning Commission hereby grants a Conditional Use Permit for property described in Section 1, subject to the conditions contained within the attached Exhibit A. Section 6. This action shall become final and effective ten (10) days after this decision by the Planning Commission, unless within such time a written appeal is filed with the City Clerk for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 7. This resolution is the result of an action taken by the Planning Commission on January 17, 1994, by the following vote: YES: Lowrey, NO : None ABSENT: Ortiz ABSTAIN: None Ruiz, Young, Breen Section 8. The secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and Rosemead City Clerk. APPROVED and ADOPTED this 7th day of February, 1994. W. LIQUOR CONDITIONS OF APPROVAL JANUARY 17, 1994 1. Apply for a City of Rosemead Business License and Occupancy Permit. All conditions herein must be complied with before issuance of said permits. 2. Comply with the requirements of the Building/Fire Departments. 3. Maintain the property in a clean and litter-free state. 4. This Conditional Use Permit is approved for a period of one year, at which time it may be reviewed by the Planning Commission without a public hearing. This permit is not transferable to future purchasers or occupants. The applicant assumes responsibility for all conduct on the premises. 5. .Adequate lighting shall be provided in the parking area. Motion-activated lights shall be installed where deemed appropriate by the Director of Planning. All exterior lighting shall be directed away from adjacent properties. 6. The parking space markers shall be re-painted periodically to City standards to the satisfaction of the Planning Department, including double-striping and wheel stops. 7. The hours of operation shall be posted in the front window or door. 8. Signs shall comply with Sections 9900-9908 of the Rosemead Municipal Code. Specifically, signs shall not cover more than 15% of window area or 25% of wall areas. 9. The appropriate license from the California Alcoholic Beverage Control shall be maintained. 10. That all trash, debris, and abandoned vehicles be removed from the parking area within thirty (30) days. 11. That the trash enclosure gates be repaired within thirty (30) days. 12. No improvements shall be done to the structure, interior or exterior which could create a fire hazard. 13. Within ten (10) days after approval, the applicant shall submit a notarized Affidavit of Agreement with the Planning Department. SCUP604
