MINUTES
1. CALL TO ORDER - The regular meeting of the Planning Commission
of the City of Rosemead was called to order by Chairman Young at
7:00 p.m. in the Council Chambers of the Rosemead City Hall,
8838 E. Valley Boulevard, Rosemead.
The Pledge of Allegiance was led by Chairman Young.
The Invocation was delivered by Commissioner Ruiz.
2. ROLL CALL - Present: Lowrey, Ruiz, Young, Breen, Ortiz
Ex Officio: Wagner, Price, Lyons,
Chicots, Troyer, Pitzer
3. APPROVAL OF MINUTES - Regular meeting of September 20, 1993
(MO) It was moved by Commissioner Ortiz, seconded by Commissioner
Breen, to approve the minutes of the regular meeting of
September 20, 1993, as presented. Vote resulted:
Yes: Lowrey, Ruiz, Young, Breen, Ortiz
4. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City
Attorney Stanton Price explained the public hearing process and
the right to appeal decisions of the Planning Commission to the
City Council.
5. ADMINISTRATION OF OATH - The secretary administered the oath to
members of the audience wishing to speak.
PUBLIC HEARINGS
6. TENTATIVE PARCEL MAP 23731 - 7760 Hellman Avenue - Request from
Bang Bach Trinh to subdivide an existing lot into two parcels to
facilitate single-family home development (cont'd from 9-20-93).
Mr. Lyons presented the staff report with the recommendation to
approve.
The Chairman opened the public hearing.
Addressing the Commission in favor of the request was:
Tom Cao, 735 W. Emerson, Monterey Park. Mr. Cao stated that he
was the project engineer and accepted the conditions of approval
on behalf of the property owner.
There being no one else wishing to address the Commission, the
public hearing was closed.
Discussion by the Commission:
Commissioner Ortiz inquired if the project adhered to the City's
second story setback requirements, and was informed by Mr. Lyons
that it did.
(MO) It was moved by Commissioner Breen, seconded by Commissioner
Lowrey, to approve Tentative Parcel Map 23731, subject to the
conditions of approval. Vote resulted:

7. TENTATIVE PARCEL MAP 23864 & MODIFICATION OF CONDITIONAL USE
PERMIT 92-573 - 7833 & 7839 Emerson Place - Request from
Godakalana Gunaratana to consolidate two parcels into one to
facilitate development of a library/meeting room addition for
the existing temple (cont'd from 9-20-93).
Mr. Chicots presented the staff report with the recommendation
to approve.
The Chairman opened the public hearing.
Addressing the Commission in favor of the request was the
applicant, Godakalana Gunaratana, 7833 Emerson Place, Rosemead.
Mr. Gunaratana stated that he had reservations about the
requirement of a six-foot high masonry wall along the easterly
and northerly perimeter property line, based on possible
graffiti problems, and also the requirement to save the existing
eucalyptus trees, based on loss of parking spaces and liability
problems, but that he was willing to do whatever the City
required. Mr. Gunaratana assured the Commission that the
proposed library would be a unique asset to the City.
Henry Wan, 4541 N.Darlow Avenue, Rosemead, engineer of the
project. Mr. Wan stated that the plans are in conformance with
local and state requirements and that the conditions of approval
are acceptable.
Addressing the Commission in opposition to the project was:
Lino Nardini, 7831 E. Emerson Place. Mr. Nardini stated that
the project could be the cause of possible devaluation of his
property; that the six-foot block wall on the west side of his
property is blocking his view into the neighbor's yard, which
reduces the safety of both properties; that the block wall
interferes with the drainage in the back of his yard; and that
the proposed project would increase traffic on Emerson.
Mr. Lyons responded that the block wall was legally built in an
effort to cut down on possible noise originating from the
temple; that proper seepholes were installed in the block wall
at the time of construction; that although problems about the
wall are a civil matter between the property-owners, the City
Engineer inspected the wall and recommended correction; and that
the problem with this wall is unrelated to the proposed project,
which will drain completely to the street.
Given an opportunity for rebuttal, Mr. Gunaratana stated that
the location of Emerson between Garvey and the #10 freeway is
the cause of heavy traffic.
There being no one else wishing to address the Commission, the
public hearing was closed.
Discussion by the Commission:
Commissioner Breen stated his opinion that the project would not
negatively affect the traffic on Emerson compared to regular R-2
development.
Commissioner Breen asked for clarification about the Edison
right-of way mentioned in the staff report.
Mr. Chicots responded that the applicant was made aware that the
two power poles on the property not only serve the proposed
temple/library, but also the adjacent school, and that the
applicant understands that the standard condition is that all
utilities shall be underground.

Commissioner Ortiz expressed his preference on construction,of a
six-foot block wall around the easterly and northerly perimeter
property line rather than other types of fencing, based on
safety and noise factors.
(MO) It was moved by commissioner Lowrey, seconded by Commissioner
Ortiz, to approve Tentative Parcel Map 23864 and Modification of
Conditional Use Permit 92-573, subject to the conditions
outlined in Exhibit A as amended. Vote resulted:

OTHER BUSINESS
8. EXTENSION OF CONDITIONAL USE PERMIT 92-557 - Request to continue
the operation of a game arcade at 8150 E. Garvey Avenue #118
(Diamond Square Funland).
Mr. Troyer presented the staff memorandum and recommended a two
(2) year extension.
Commissioner Ortiz was in favor of the extension, but asked for
clarification on the legality of the center's security guards
placing notices on illegally parked vehicles and the towing
procedures.
(MO) It was moved by Commissioner Lowrey, seconded by Commissioner
Ortiz, to extend Conditional Use Permit 92-557, subject to
conditions 1 through 21. Vote resulted:

9. EXTENSION OF CONDITIONAL USE PERMIT 80-195 - Request to continue
the sale of alcoholic beverages for off-site consumption at 8807
Mission Drive (7/Eleven).
Mr. Troyer presented the staff memorandum and recommended a
three (3) year extension.
(MO) It was moved by Commissioner Lowrey, seconded by Commissioner
Ruiz, to extend Conditional Use Permit 80-195, subject to
conditions 1 through 9. Vote resulted:
Yes: Lowrey, Ruiz, Young, Breen, Ortiz
10. EXTENSION OF ZONE VARIANCE 92-238 - Request from Van Pham to
extend for one year a shared parking variance for a deli
restaurant located at 8632 E. Valley Boulevard Ste. J & K (BBQ
11 Restaurant).
Mr. Lyons presented the staff memorandum and recommended a one
(1) year extension.
(MO) It was moved by Commissioner Breen, seconded by Commissioner
Ruiz, to extend Zone Variance 92-238 for a period of one (1)
year, subject to conditions 1 through 7. Vote resulted:

11. PC RESOLUTION 93-50 - A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING CONDITIONAL USE PERMIT 93-580
ALLOWING THE CONTINUED OPERATION OF A KARAOKE (KTV) STUDIO DBA
CHARMING KTV LOCATED AT 7940 GARVEY AVENUE, ROSEMEAD.

12. PC RESOLUTION 93-51 - A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD GRANTING APPROVAL OF TENTATIVE TRACT MAP
51321 TO SUBDIVIDE THREE EXISTING PARCELS INTO FIVE PARCELS TO
FACILITATE SINGLE-FAMILY HOME DEVELOPMENT FOR PROPERTY LOCATED
AT 3370 BARTLETT AVENUE, ROSEMEAD.
Mr. Price presented the resolutions by title only.
(MO) It was moved by Commissioner Lowrey, seconded by Commissioner
Ortiz, to waive further reading and adopt. Vote resulted:
Yes: Lowrey, Ruiz, Young, Breen, Ortiz
13. ORAL COMMUNICATION FROM THE AUDIENCE - None
14. MATTERS FROM CITY OFFICIALS AND STAFF
A. Commissioner Lowrey inquired if at 7/Eleven and other
24-hour operations that sell alcoholic beverages, the
Commission could require that security cameras be installed
in the'interest of security. Staff will conduct a survey to
find out what surrounding cities require and check with the
Sheriff's Department.
B. Commissioner Ortiz inquired if an update was available
regarding the workshop at 2414 Walnut Grove Avenue. Mr.
Lyons responded that the Building Department had inspected
the site and handed Commissioner Ortiz a written memorandum
on the subject.
C. The Commission welcomed Gary Chicots back to the Planning
Department.

There being no further business to come before the Commission,
the meeting was adjourned at 8:20 p.m. The next meeting will
take place on Monday, October 18', 1993, at 7:00 p.m.
