VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING NOVEMBER 6, 1995 0 CALL TO ORDER - The regular meeting of the Planning Commission of the City of Rosemead was called to order by Chairman Ruiz at 7:00 p.m., in the Council Chambers of the Rosemead City Hall, 8838 E. Valley Boulevard. Pledge of Allegiance was led by Commissioner Breen. Invocation was delivered by Chairman Ruiz. ROLL CALL - Present Commissioner Loi, Lowrey, Breen, Ortiz and Chairman Ruiz - Ex Officio Wagner, Price, Lyons, Troyer & Saavedra 1. APPROVAL OF MINUTES - Regular meeting of October 16, 1995. (MO) It was moved by Commissioner Ortiz, seconded by Commissioner Breen to approve the minutes of October 16, 1995. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS - City Attorney, Stanton Price, explained the public hearing process and the right to appeal decisions of the Planning commission to the City Council. 3. ADMINISTRATIVE OF OATH - The Commission Secretary administered the oath to members of the audience wishing to speak. 4. PUBLIC HEARINGS A. GENERAL PLAN AMENDMENT 95-02 - Citywide - State mandated draft Housing Element from the Rosemead Planning Department for the 1989-1996 Planning Period. Mr. Lyons gave the staff report and recommended that the Planning commission adopt a Negative Declaration and recommend City Council approval of General Plan Amendment 95-02. Chairman Ruiz opened the public hearing and asked if there was anyone wishing to speak on behalf of this matter. There being no response, Chairman Ruiz asked if there was anyone wishing to speak against this matter. There being no response the public hearing was closed. (MO) It was moved by commissioner Lowrey, seconded by Commissioner Breen to adopt a Negative Declaration and recommend City Council approval of General Plan Amendment 95-02. Garvey Avenue, #C - Request from Edward Thieu Ho to operate a Sewing Factory, dba Standard Fashion. Mr. Lyons read the staff report and recommended approval for six employees only, subject to the conditions of approval in Exhibit A. Commissioner Lowrey asked if the applicant was agreeable to having only six employees. Chairman Ruiz then opened the public hearing and asked if there was anyone wishing to speak on behalf of this matter. Mr. Peter Kan, 727 E. Benbow property owner & representing were in agreement to have 6 that the illegal storage has parking is under control. Garvey Avenue - Request from Mr. Sang Chuong to operate a Sewing Factory,. dba C & L Fashion. Mr. Lyons gave the staff report and recommended that this item be continued to the December 4, 1995 meeting to address the unresolved issues. Chairman Ruiz then opened the public hearing and asked if there was anyone wishing to speak on behalf of this matter. Mr. Sang Chuong, 8736 Garvey Avenue, applicant stated that he was there to answer any questions the Commission had. Chariman Ruiz asked if he was in agreement to continue the hearing to December 4, 1995. Mr. Chuong answered yes. Chairman Ruiz then asked if there was anyone wishing to speak against this matter. There being no one, the public hearing was closed. The Planning Commission agreed to continue the public hearing to December 4, 1995. 0 PC Minutes 11/6/95 Page 3. D. MODIFICATION 95-02 FOR CONDITIONAL USE PERMIT 93-597 - 8450 Valley Boulevard, #121 - Request from Mr. Henry Wong to upgrade an existing permit from an existing on-sale beer and wine license (Type 41) to an on-sale general alcohol license (Type 47) in conjunction with selling food, dba 888 Seafood Restaurant. Mr. Troyer gave the staff report and recommended approval for one year, subject to the conditions in Exhibit A. Commissioner Ortiz asked if there were any incidents at the establishment. Mr. Troyer stated that it was very difficult to track this particular business, because the Sheriff's Department list the hold center as one. Mr. Lyons stated the the center has improved its security and that staff has had no information of crime since the extension in August 1995. Chairman Ruiz then opened the public hearing and asked if there was anyone wishing to speak on behalf of this matter. There being no response, Chairman Ruiz asked if there was anyone wishing to speak against this matter. There being no response, the public hearing was closed. (MO) It was moved by Commissioner Ortiz, seconded by Chairman Ruiz to approve Modification 95-02 for Conditional Use Permit 93-597 for a period of one year, subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE 5. A. EXTENSION OF CONDITIONAL USE PERMIT 87-395 - 939 N. San Gabriel Boulevard - Request from Mr. Robert Balian to continue operation of a Service Station/Mini-Market, dba Mobil oil (cont'd from 10/16/95). Mr. Lyons read the staff report and recommended approval for five years, subject to the conditions in Exhibit A. (MO) It was moved by commissioner Loi, seconded by Commissioner Ortiz to approve the extension of Conditional Use Permit 87-395 for a period of five (5) years, subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE B. EXTENSION OF CONDITIONAL USE PERMIT 90-506 - 8515 E. Garvey Avenue - Request from Ms. Laura Luong to continue operation of a Sewing Factory, dba Omega Designer. Mr. Troyer read the staff report and recommend approval for a period of two (2)' years, subject to the conditions in Exhibit A. PC Minutes 11/6/95 Page 4 Commissioner Ortiz stated that he had observed bags on the stairway and storage area was a mess. (MO) It was moved by Commissioner Ortiz, seconded by Commissioner Breen to approve the extension of Conditional Use Permit 90-506 for a period of one year, subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE Commissioner Ortiz then stated that he would like the establishment inspected periodically for compliance. C. EXTENSION OF CONDITIONAL USE PERMIT 91-536 - 8405 E. Garvey Avenue - Request from Curtis & Mike Kim to continue an off-sale beer and wine (Type 20) license, dba Alta Dena Dairy. Mr. Lyons read the staff report and recommended approval for three years, subject to the conditions in Exhibit A. Commissioner Lowrey asked if the applicant was in agreement with the conditions. Ms. Kim, 8405 Garvey Avenue answered yes. Mr. Lyons stated that these were standard conditions, very little change. (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Ortiz to approve the extension of Conditional Use Permit for a period of three years, subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE Commissioner Loi asked about condition #16. He stated that there was a public phone there. Also inquired that there was no handicapped parking spaces at the location. Mr. Lyons stated that there are no improvements made to the establishment, therefore can not require new handicapped spaces. D. EXTENSION OF CONDITIONAL USE PERMIT 92-557 - 8150 E. Garvey Avenue - Request from Fun Zone to continue the operation of a Video Arcade. Mr. Troyer read the staff report and recommended approval for a period of three (3) years, subject to the conditions in Exhibit A. Commissioner Loi asked if this was Funland or Funzone? Mr. Lyons stated that it could be just a typographical error, but will check into it. PC Minutes 11/6/95 Page 5. Commissioner Ortiz stated that there were extension cords in the aisles and the electrical plugs were not cover properly. Children could insert pens or other items and cause injury. Mr. Steve Zuckerman, property manager, Diamond Square, stated that he would investigate the situation and have the problem taken care of. (MO) It was moved by Commissioner Breen, seconded by Commissioner Loi to approve the extension of Conditional Use Permit 92-557 for a period of three (3) years, subject to the conditions in Exhibit A. Vote resulted: YES: LOI, LOWREY, RUIZ, BREEN, ORTIZ NO: NONE ABSENT: NONE ABSTAIN: NONE D. EXTENSION OF CONDITIONAL USE PERMIT 92-564 - 8450 E. Garvey Avenue, #201 - Request from the Chinese Cultural Services Center to continue the operation of an Institution. Mr. Troyer read the staff report and recommended approval for three (3) years, subject to the conditions in Exhibit A. Commissioner Ortiz inquired about the underground parking. Ms. Fong, 8450 Garvey, #201, representing the establishment, stated that the underground parking was for staff only. There is enough parking in the rear for the customers. Mr. Lyons stated that the City was still in the process of straighting out the center, but that this tenant was going by the rules. Mr. Troyer stated that the ladies of the center had fears that if the gate to the underground parking was opened and that they were working late at night, people could be waiting there to rob them, assault them, etc. (MO) It was moved by Commissioner Lowrey, seconded by Commissioner Ortiz to approve the extension of Conditional Use Permit 92-564 for a period of three (3) years, subject to the conditions in Exhibit A. EXTENSION OF CONDITIONAL USE PERMIT 94-621 - 2732 Stingle Avenue - Request from Sau Ping Kan & Pei Zhen Li to continue operation of a Sewing Factory, dba KK Garment Factory. Mr. Lyons read the staff report and recommended approval for two (2) years, subject to the conditions in Exhibit A. Commissioner Loi asked if the applicant was concerned with condition #19, regarding the maximum of 25 employees. Mr. Lyons stated that this Conditional Use Permit was approved with the maximum load of 25 employees in 1994. The occupancy load was determined by the Building Code. PC Minutes 11/6/95 Page 6 Commissioner Loi asked the applicant if he was satisfied with the 25 employees or wanted to hire 3 more. Mr. Kan, 2732 Stingle Avenue, stated that he was in agreement with the 25 employee maximum. (MO) It was moved by Commissioner Loi, seconded by Commissioner Breen to approve the extension of conditional Use Permit 94-621 for a period of two years, subject to the conditions in Exhibit A. MATTERS FROM CITY OFFICIALS AND STAFF Mr. Lyons stated that he had talked to Josie and that she will be going home temporally. Will have to return to the hospital for the stem celling process. PC Minutes 11/6/95 Page 7 Commissioner Loi mentioned about changing the clock in the Council Chamber, still showing old time. Commissioner Lowrey stated that he and his wife, Mildred, were celebrating their 50th Wedding Anniversary. Commissioner Ortiz stated that there is a problem with the trash container at the Laser Tech Center on Garvey Avenue. Mr. Lyons stated that Code Enforcement has a case going on this matter. Commissioner Ortiz also stated that at 8450 Valley Boulevard, Bon Bon Sushi, had wood around windows and also tinted windows. Mr. Lyons stated that staff will investigate. Commissioner Ortiz stated at the laundry at Hellman and Walnut Grove they have six video games inside, thought they could only have three. Also wanted to congratulate Commissioner Lowrey and his wife a Happy Anniversary. There being no other business to come before the Commission, the meeting was adjourned at 8:10 p.m. The next meeting will take place on November 20, 1995 at 7:00 p.m.
