CC - Item 9A - Proposed League of Cities ResolutionsE ~ E S ° City of Rosemead P~ Memorandum To: Honorable Mayor and City Council Members From: Steven Ly Mayor Pro Tern Date: July 13, 2010 Re: Proposed League of California Cities Resolutions Mayor Pro Tern Ly is asking that the City Council consider the support of two resolutions proposed to be presented to the League of California Cities General Assembly as drafted by Mr. Ly. ITEM NO. RESOLUTION REGARDING THE GLOBAL WARMING SOLUTIONS ACT OF 2006 (AB 32) WHEREAS, when the Global Warming Solutions Act of 2006 (AB 32) was adopted, California unemployment was at 4.8%, while today California unemployment is approximately 12%1; and WHEREAS, a study from the California State University, Sacramento noted that AB 32 implementation could "'easily exceed $100 billion' and that the program would raise the cost of living by $3,857 per household each year by 2020"2; and WHEREAS, California's non-partisan Legislative Analyst Office rebuffed the California Air Resources Board's (CARB) job growth assessment, stating that, "While CARB did not estimate job impacts for other time periods, it seems most likely to us that the implementation of AB 32 through the [Scoping Plan] will result in the near term in California job losses, even after recognizing that many of the [Scoping Plan's] programs phase in over time"3; Therefore Be it RESOLVED, by the General Assembly of the League of California Cities, assembled in Annual Conference in San Diego, September 17, 2010, that the League support legislation and measures that will suspend AB 32 implementation until California unemployment returns to 5 percent or lower; Be it Further RESOLVED, the General Assembly shall authorize the League Board of Directors to further implement the League position. Cogdill on March 14, 2010 RESOLUTION REGARDING THE SUSTAINABLE COMMUNITIES STRATEGY LEGISLATION (SB 375) WHEREAS, the Sustainable Communities Strategy Legislation (SB 375) is designed to be a land- use implementation component via transportation conformity for AB 32; and WHEREAS, SB 375 is an unfunded mandate for regional Municipal Planning Organizations (MPO) even if Proposition 84's "sustainable planning funds" are fully allocated'; and WHEREAS, SB 375 calls for higher density residential developments as a means to meet the Regional Housing Needs Assessment (RHNA) numbers or as a means to encourage Transit Oriented Developments (TOD), which may be a direct challenge to local (city) land-use control2; Therefore Be it RESOLVED, by the General Assembly of the League of California Cities, assembled in Annual Conference in San Diego, September 17, 2010, that the League support legislation and measures that will suspend SB 375 implementation until California legislature fully funds all implementation costs and addresses the loss of local land-use control; Be it Further RESOLVED, the General Assembly shall authorize the League Board of Directors to further implement the League position.
